of Approval shall be completed within 180 days from the issuance of the <br /> building permit. <br /> Development Title Section 9-240.8 states that whenever an application is made to <br /> correct a violation where a citation has been issued, the cost of the application shall be <br /> two (2) times the application fee normally charged for the application, up to a maximum <br /> of five hundred dollars ($500) over the application fee normally charged. <br /> Animal Enclosures <br /> Development Title Table 9-1045.3 states that except for movement on and off the <br /> property, animals shall not be kept or maintained in pens, corrals, or within barns or <br /> similar structures, on property of less than '/2 acre, closer than 40 feet from any rear or <br /> side property line. The "open stalls" and "portable open pens" as shown on the site plan <br /> appear to be closer than 40 feet from the side property line. The structures are adjacent <br /> to the Union Pacific Railroad (UPRR). The UPRR has an existing right-of-way of 100 <br /> feet. It is unclear whether the UPRR has a right-of-way easement or if it owns the right- <br /> of-way in fee. Because the structures are closer than 40 feet from the side property line, <br /> and because the Community Development Department does not have any record of <br /> building permits for the "open stalls", the applicant will need to provide at least one of the <br /> following if a full application is submitted: <br /> 1. A deed indicating that the UPRR right-of-way is an easement and not owned in <br /> fee. This would indicate that the UPRR right-of-way is not a property line and <br /> therefore, the 40-foot setback requirements would not be applicable. <br /> 2. Provide a Building Permit number and/or document indicating that a permit was <br /> obtained to construct the "open stalls" for the purpose of housing animals. If the <br /> building was constructed for the purpose of housing animals, the building may be <br /> considered a legal non-conforming structure. <br /> Parkin <br /> Development Title Section 9-1015.3(b) states that 0.67 parking spaces are required per <br /> 1,000 square feet of building space for the use type Stable-Neighborhood. <br /> Approximately 2,160 square feet of the "open stalls" is considered actual building space. <br /> The remaining 3,456 square feet is fencing used for open paddocks. The "portable open <br /> pens" have a roof structure and are therefore counted as building space. As a result, a <br /> minimum of three (3) parking spaces are required, one of which shall be van accessible. <br /> The parking spaces may be located near the front of the project site near the residence. <br /> Each parking space shall be an unobstructed rectangle, minimum nine (9) feet wide and <br /> twenty (20) feet long (Development Title Section 9-1015.5(b)) <br /> Surfacing <br /> Development Title Section 9-1015.5(e) states that all permanent parking lots (which <br /> include parking spaces, driveways, and maneuvering areas) shall be surfaced and <br /> permanently maintained with asphalt concrete or Portland cement concrete to provide a <br /> durable and dust free surface. Development Title Section 9-1015.9 states that the <br /> requirements of the [Parking] Chapter may be modified by the Director in cases in which <br /> the requirements may be considered insufficient or excessive. The applicant is <br /> proposing to surface the driveway and parking area with gravel. Because the proposed <br /> use will generate a low number of trips, the Community Development Department may <br /> 2 <br />
