CONDITIONS OF APPROVAL <br /> MS-99-20 <br /> Burns <br /> Minor Subdivision Application No. MS-99-20 was approved by the San Joaquin County Community <br /> Development Department on March 1, 2000. The effective date of approval is March 11, 2000. This <br /> tentative map approval will expire on March 11, 2003,which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Tina Wehrmeister,468-8477) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Tentative Map <br /> dated September24, 1999. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 200 feet. (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 10 acres.(Development Title Section 9-610.2) <br /> c. ACCESS: The proposed 25-foot-wide private easement for access to Parcels 3 and 4 shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> d. UNIFORM FIRE CODE: The following Uniform Fire Code and San Joaquin County Ordinance Code <br /> requirements will be applicable and shall be incorporated in the construction plans before submittal <br /> to the Community Development Department for a building permit: <br /> (1) Fire department access roads shall be in accordance with Section 902.2 of the California Fire <br /> Code and the standards adopted by the San Joaquin County Fire Chiefs Association. <br /> (2) The fire access road shall be constructed prior to recordation of the Parcel Map. <br /> e. TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance. (Development Title Section 9-1505) <br /> f. RIPARIAN HABITAT ZONE: Parallel to Bear Creek, a natural open space area for riparian habitat <br /> and waterway protection shall be maintained to provide nesting and foraging habitat and the <br /> protection of waterway quality. The minimum width of said open space shall be one-hundred(100) <br /> feet, measured from the mean high water level of the natural bank or fifty (50) feet back from the <br /> existing riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. The mean high water level and the edge of the riparian habitat shall be shown on the Parcel <br /> Map.
