(1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is designated as a natural open space for riparian habitat and waterway protection. No development other than water dependent uses shall be permitted in this space. g. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric or historic-period materials are encountered, all work in the vicinity of the find shall halt until an archaeologist can evaluate the materials and make recommendations for further action. If human remains are encountered, all work shall halt in the vicinity, and the County Coroner and the Community Development Department shall be notified immediately. The following note shall be recorded on the parcel map: (1) This parcel contains vernal pools, wetlands, or other features that may provide habitat for Federally and/or State protected species. Prior to changing the land use of this parcel or making any physical changes to the land, including but not limited to grading, disking, ripping, or minor constructions, the property owner is required to consult with the appropriate Federal and/or State agencies having jurisdiction over the resources and follow any recommended actions prescribed by the agencies. 6. DEPARTMENT OF PARKS AND RECREATION (Staff Contact:Jeff Smith,953-8800) a. PARK FEES: Due to the relatively small size of the subdivision,less than fifty (50) parcels,the San Joaquin County Department of Parks and Recreation will require the collection of in-lieu fees for park developmentas a requirementfor approval of the Parcel Map. (Development Title Section 9-1230.8) 7. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of the GovernmentCode.
