CONDITIONS OF APPROVAL MS-99-21 Tessie Estates Minor Subdivision Application No. MS-99-21 was approved by the San Joaquin County Community Development Department on November 16, 1999. The effective date of approval is November 26, 1999. This tentative map approval will expire on November 13, 2001, unless (1) all Conditions of Approval have been complied with and(2)a Parcel Map has been recorded. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified,and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Tina Wehrmeister,468-8477) a. TENTATIVE MAP: The Parcel Map shall substantially conform with the Tentative Map submitted October 1, 1999. The Parcel Map shall be recorded by November 13, 2001,which is the termination date of the will serve commitmentfrom the Lockeford Community Services District. b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: (1) All parcels shall have a minimum lot width of 60 feet, measured at the front yard setback line. (Development Title Section 9-310.4) (2) All parcels shall have a minimum lot area of 8,000 square feet. (Volume II, General Plan Policy No.2 Specific to Lockeford) c. LANDSCAPING: Landscaping shall be provided and comply with the following: (1) Street trees are required as specified in Section 9-1020.4 of the Development Title. 2. DEPARTMENT OF PUBLIC WORKS (See the attached memo dated November 1, 1999.) 3. PUBLIC HEALTH SERVICES (See the attached memo dated November 1, 1999.) 4. DEPARTMENT OF PARKS AND RECREATION (Staff Contact:Jeff Smith,953-8800) a. PARK FEES: Due to the relatively small size of the subdivision,less than fifty (50) parcels,the San Joaquin County Department of Parks and Recreation will require the collection of in-lieu fees for park developmentas a requirementfor approval of the Parcel Map. (Development Title Section 9-1230.8) 5. COUNTY COUNSEL (Staff Contact:DeeAnne Watkins,468-2980) a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of the Government Code.
