The diesel UST compartment has a breach in the primary wall allowing brine to be weeping into the <br /> diesel UST thus the interstitial space of the UST system is not maintained continuously. The sensors <br /> monitoring the liquid level in the interstitial space shall be maintained so that a breach in the primary or <br /> secondary containment is detected before the hazardous substance is released into the environment. <br /> Since the 91/diesel UST annular system is not continuously monitored, both 91 and diesel UST systems <br /> must cease operation until repairs or replacement of the UST is completed. <br /> 9999. CCR 2672. Since Xerxes is unable to repair the 91/diesel primary wall, permanent closure will <br /> apply to the USTs in which storage of hazardous substances has ceased and tanks will not be used, or <br /> not intended for use, for the storage of hazardous substances within the next 12 consecutive months. <br /> The entire 91/diesel UST systems, including its piping, must have its residual liquid, solids, or sludges <br /> removed and handled as hazardous waste. The day prior to Xerxes inspection, on October 28, 2013, <br /> only the diesel tank, not the piping to the dispensers, has been triple rinsed. The UST systems, including <br /> piping, shall be inerted to levels that shall preclude explosion or to lower levels as required by the Tracy <br /> Fire Department. Obtain a permit from EHD for the permanent closure of 91/diesel UST system within <br /> 30 business days. <br /> Submit to SJC EHD within 30 days (12/2/13): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement for violation 201 <br /> 3. complete Permanent Closure application <br /> Notes: <br /> - Diesel sale prices removed, yellow bags "Out of Service" has been placed on dispenser nozzles. <br /> Diesel tank has been triple rinsed and waste removed on October 28, 2013. <br /> - Did not test the Diesel: overfill prevention (ATG probe out), positive shut down and electronic line leak <br /> detector (turbine disconnected), smart sensors (cannot pull vacuum), and spill bucket (removed to <br /> prevent fuel deposition). <br /> Did test for the fill and STP sump annular sensors, fill and STP sump sensors. <br /> - Attempted to create CERS account but CERS unable to send email to user to activate account. Tried <br /> two different email addresses. <br /> - Financial responsibility documents on site.
