Fine Road, Linden) <br /> ACTION: On February 23, 2000, the San Joaquin County Community Development Department denied MS- <br /> 99-24 due to the inability to make required Finding No. 7(attached). <br /> Section 9-1150.15(b) of the Development Title states that in nonagricultural areas, any private right-of- <br /> way that exceeds the length provided for in Section 9-1150.13 shall have a secondary method of access. <br /> Section 9-1150.13(a) states that cul-de-sac streets shall not have a length exceeding 1,000 feet, except <br /> where existing physical conditions make such limitations of length impractical. <br /> Staff has reviewed your application for possible physical conditions which would make the above length <br /> requirement impractical and found none. A site inspection found the site relatively flat with no apparent <br /> physical barriers impairing the applicant's ability to provide the required secondary access. <br /> APPEAL PERIOD: This action can be appealed to the Planning Commission by any interested party. <br /> Appeals must be filed with this Department within 10 days of the action with an appeal fee of$275.00. The <br /> 10-day appeal period ends at 4:30 p.m. on March 4, 2000. If this date falls on a weekend or holiday, the <br /> appeal period will expire on the next regular business day at 4:30 p.m. Please note that ordinance <br /> requirements cannot be appealed.
