VR-00-02 OF ROSS C. BROWN <br /> TRUSTEE. LOCATED ON THE NORTH SIDE OF WEST RIPON ROAD <br /> 500-FEET EAST OF ALICE ROAD, WEST OF RIPON. <br /> The applicant has submitted the above referenced application for the purpose of varying <br /> the required 40-acre minimum lot size to 1.80 acres and the minimum lot width from <br /> 330-feet to 242-feet to permit a Minor Subdivision application. The property has a <br /> General Plan designation of General Agriculture (A/G) and a Zone classification of <br /> General Agriculture, 40-acre minimum (AG-40). The project site is 14.29 acres and <br /> contains two dwellings. The second house was approved as a Second Unit Dwelling, <br /> SD-87-08. <br /> This item is scheduled to be heard by the Planning Commission on September 21, <br /> 2000. <br /> The Community Development Department has reviewed the application and will be <br /> recommending that the Planning Commission deny the Variance. To support such a <br /> Variance, three Findings must be made. Staff is unable to make two of the three <br /> Findings, specifically Findings 1 and 2. <br /> Finding no. 1: Because of special circumstances applicable to the property, including <br /> size, shape, topography, location, or surrounding, the strict application of the zoning <br /> regulations deprives the property of privileges enjoyed by other properties in the vicinity <br /> and under identical zone classification. <br /> • This finding cannot be made because there is no documentation that there are <br /> special circumstances specific to this property relative to its size, shape, <br /> topography, location, or surrounding that would support the Variance. <br /> Finding no. 2: The granting of the Variance will not constitute a grant of special privilege <br /> inconsistent with the limitations upon other properties in the vicinity and zone in which <br /> the property is situated. <br />
