-2- <br /> REASON FOR RECOMMENDATION: <br /> A building permit for grading of the parking lot was issued on January 13, 2004. The required <br /> paving and landscaping of the site has been completed. The original enforcement case that was <br /> opened on the property has been closed. <br /> Ms. Spyksma—Pilchard and her attorney raised several issues in their letters of August 11, 2003, <br /> June 21, 2004, June 23, 2004 and September 24, 2004. After receiving the letters of June 21, <br /> 2004 and June 23, 2004, an Enforcement Officer visited the site. At that time (July 2004)the <br /> landscaping had not been completed, the trash enclosure screening had not been built and the <br /> masonry wall had not been built. No other violations were found and an enforcement case was <br /> not opened. The issues raised in the above letters and in other letters submitted after the Board <br /> denied the appeal (March 25, 2003) are addressed below: <br /> Screening <br /> It is a Condition of Approval 1.i(1)that trash bins be screened. This Condition must be completed <br /> within 18 months of approval of the project. This requirement has been completed. <br /> Condition of Approval 1_i (2) requires that a six to seven foot tall masonry wall be erected along <br /> the adjoining property lines. The Development Title Section 9-1022.2(c)(2) does not permit a ten <br /> foot high wall to be erected along property lines. In order to build a wall over seven feet tall it <br /> would be necessary to meet building set backs for the zone. In the AG-40 zone the side setback <br /> is ten feet and the rear setback is 30 feet. There was an earlier agreement between the VFW <br /> and adjacent property owners that delayed the building of the masonry wall. The wall has not <br /> been built. Ms. Spyksma-Pilchard's attorney is requesting that the VFW build the wall <br /> immediately. <br /> Overnight Parking of Recreational Vehicles <br /> The overnight parking of recreational vehicles is prohibited by Condition of Approval 1.m. <br /> Parking <br /> Condition of Approval 1.d (1) requires that driveway and surfacing areas be surfaced and <br /> permanently maintained with asphalt or Portland concrete. Parking spaces shall be surfaced with <br /> a minimum of four inches of aggregate base. The paving of the parking areas has been <br /> completed. The designated parking areas are located on the north and southwest sides of the <br /> building. <br /> Outdoor amplified music <br /> Outdoor amplified music is prohibited by Condition of Approval 1.n. <br />
