INTRODUCTION <br /> Due to concerns regarding potential liability for toxic hazards which may adversely impact real estate <br /> in general,investors need to assess the property in question to determine if current or past occupants <br /> or surrounding land uses could adversely impact property development or result in future liability for <br /> the investor. Good commercial and customary practice for conducting a Surface/Subsurface <br /> Contamination Report for a parcel of property is to identify recognized environmental conditions. <br /> According to ASTM Standard E 1527 - 00/paragraph 1.1.1,the term recognized environmental <br /> conditions means "...the presence or likely presence of any hazardous substances or petroleum <br /> products on a property under conditions that indicate an existing release, a past release, or a material <br /> threat of a release of any hazardous substances or petroleum products into structures on the property <br /> or into the ground, groundwater, or surface water of the property." <br /> B. LIMITATIONS <br /> This report was compiled as a Surface/Subsurface Contamination Report for the subject project. This <br /> report contains information and data provided to NOA ENVIRONMENTAL by several sources. <br /> NOA ENVIRONMENTAL in no way warrants the accuracy or completeness of the information <br /> provided to this investigation by those sources. <br /> It should be noted that when a surface/subsurface assessment is completed without sample collection <br /> and quantitative analysis of soil and groundwater beneath the site, as in this study, no statement of <br /> scientific certainty can be made regarding latent subsurface conditions which may be the result of on- <br /> site or off-site sources. The findings and conclusions of this report are not scientific certainties,but <br /> rather,probabilities based on professional judgement concerning the significance of the data gathered <br /> during the course of this investigation. NOA ENVIRONMENTAL is not able to represent that the <br /> site or adjoining land contains no hazardous waste, oil, underground storage tanks, or other latent <br /> condition beyond that detected or observed by NOA ENVIRONMENTAL during the <br /> Surface/Subsurface assessment. The possibility always exists for contaminants to migrate through <br /> surface water, air, or groundwater. <br /> Our office has not been provided with specific criteria for the development of this report other than <br /> a request to evaluate the property in question for possible problems related to toxic or hazardous <br /> agents,nor have we been directed to address any specific questions concerning the site. Should there <br /> be a need to conduct an investigation into a specific question not addressed in this report, contact our <br /> office immediately regarding your concerns. <br /> 2 <br />
