(Apex) in response to our letter dated February 28, 1994, regarding the <br /> above referenced site. <br /> In the February 28, 1994 letter, PHS/EHD directed you to submit a time table with <br /> dates for submittal of a closure plan for the underground storage tanks (UST's) , <br /> removal of the UST's, and submittal of a plan for over-excavation and groundwater <br /> extraction by April 1, 1994. The March 3, 1994 letter from Apex merely states <br /> that "tank replacement is still tentatively scheduled for early 1995". PHS/EHD <br /> staff informed Apex and you in telephone conversations on March 15, 1994 and <br /> March 17, 1994, respectively that this response was not sufficient. <br /> As stated in the PHS/EHD letter, State Water Resources Control Board Underground <br /> Storage Tank Cleanup Fund Program (Cleanup Fund) staff has reviewed our file for <br /> this site. It is our understanding that a Letter of Commitment for this site <br /> will not be issued until the site has complied with our directives. If the above <br /> dates for submittal of a closure plan, a work plan and dates for performance of <br /> the work are not provided to PHS/EHD in writing by April 28, 1994, the Cleanup <br /> Fund staff will be notified that the site is not in compliance with our <br /> directives. <br /> In addition, please be advised that quarterly sampling and reporting for this <br /> site is to continue.
