Box 388 • Stockton, CAt-t <br /> (209) 468-3420 <br /> RICHARD ROWLAND CEG STEVE GURNSEY <br /> TERRASEARCH INC FRONTIER DRILLING <br /> 1380 N FOURTH ST 1730 HAMMOND DR <br /> SAN JOSE CA 95112-4676 TURLOCK CA 95382 <br /> RE: Nicholaw Parcel <br /> Byron Road <br /> Tracy, CA <br /> On May 18, 1994 San Joaquin County Public Health Services, Environmental Health Division (PHS-EHD) <br /> received a copy of the results of an environmental assessment done at the aboved referenced property. <br /> These results were addressed to Ms. Wendy Cohen of the Central Valley Regional Quality Control Board <br /> (CVRWQCB) and requested that PHS-EHD be allowed to be the "lead" agency for oversight for the <br /> investigation at this site since prior such authorization has been granted to PHS-EHD for other sites in <br /> the area. <br /> PHS-EHD requires a workplan to be reviewed and approved for sites intending to conduct subsurface <br /> investigations. In addition, San Joaquin County Development Title Section 9-1115.3 requires that a well <br /> permit shall be approved by the Director of the Environmental Health Division prior to drilling any <br /> subsurface boring. <br /> In phone conversations with Mr. Richard Rowland on May 18, 1994 it was verified that the drilling done <br /> on site was without a boring permit,without a workplan submittal or approval, and without an inspection <br /> of the destruction or construction of the borings or monitoring well. <br /> In order to discuss this violation of the San Joaquin County Developmental Title, an office hearing has <br /> been scheduled for June 23, 1994 at 2 p.m., at 445 N.
