Filbert Street <br /> Stockton, CA 95205 <br /> On October 17, 1994, as represetatives of San Joaquin County Public <br /> Health Services, Environmental Health Division (PHS/EHD) Diane <br /> Hinson and I met with you and Grant Stewart from CH2M Hill to <br /> discuss the above referenced site . The following is a summary of <br /> the items discussed and additional comments . <br /> You were provided with the portion of our Local Oversight Program <br /> contract with State Water Resources Control Board that states who <br /> we can name as responsible parties and Section 2720 of the <br /> California Code of Regulations, Title 23 , Division 3 , Chapter 16, <br /> Article 11 (Corrective Action Requirements) . Both documents state <br /> that any owner of property where an unauthorized release of <br /> petroleum from an underground storage tank (UST) has occurred is a <br /> responsible party and any person who owned or operated the UST <br /> immediately before the discontinuation of its use is a responsible <br /> party. <br /> You stated that a title search had been completed for this property <br /> and a copy would be provided to PHS/EHD. On October 18 , 1994, you <br /> provided PHS/EHD with a copy of an inter-office correspondence that <br /> states Calpak Properties (Del Monte) purchased the property from <br /> Parmaceast on April 1, 1976 but have not identified if Parmaceast <br /> owned or operated the UST' s . Until the person who owned or <br /> operated the UST's is identified Del Monte will remain the only <br /> listed responsible party for the site . <br /> You also were provided with Section 2721 of the Corrective Action <br /> Requirements that states that responsible parties shall take <br /> corrective action in compliance with all applicable waste discharge <br /> requirements commencing with section 13000 of the Porter-Cologne <br /> Water Quality Control Act and State Water Resources Control Board <br /> Resolution No. 92-49 which requires that wastes discharged to the <br /> waters of the state should be cleaned up to background conditions <br /> or the quality that existed before the discharge . Since petroleum <br /> hydrocarbons are not naturally occurring in the groundwater Del <br /> Monte is responsible for cleaning up the entire plume of petroleum <br /> hydrocarbon contaminated groundwater both on and off site . <br /> A I)i,isiun of San.Inawdn Cnuntn Health Marc Ser%ice� <br />
