Promptly notify Engineer of all conflicts, errors, ambiguities, or f discrepancies which Bidder has discovered in or between the Contract Documents and such other related documents. 4.2. The submission of a Bid will constitute an incontrovertible representation by Bidder that Bidder has complied with every requirement of this article; that without exception the Bid is premised upon performing and furnishing the Work required by the Bidding Documents and applying the specific means, methods,. } techniques, sequences, or procedures of construction (if any) that may be shown or indicated or expressly required by the Bidding Documents; that Bidder has given Engineer written notice of all conflicts, errors, ambiguities, and discrepancies that Bidder has discovered in the Bidding Documents, and the written resolution thereof by Engineer is acceptable to Bidder; and that the Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performing and furnishing the Work and for preparing the Bid. , 5. INTERPRETATIONS AND ADDENDA. 5.1. All questions about the meanie or intent of the Bidding Documents are to be g g directed to Engineer. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda mailed or delivered to all parties recorded by the office issuing documents as having received the Bidding Documents. Questions received less than 5 days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without.legal effect. 5.2. Addenda may also be issued to modify the Bidding Documents as deemed advisable by Owner or Engineer. 6. CONTRACT TIMES. 6.1. Contract Times are set forth in the Agreement. 6.2. The times proposed by Bidder: (i) to achieve Substantial Completion, and h (ii) to complete the Work so that it is ready for final payment, shall be indicated on Bid Form. Such proposed times will be taken into consideration by Owner. Upon request, Bidder(s) shall present sufficient information to substantiate Bidder's capability and capacity to achieve such proposed times. 6.3. Substantial Completion is desired on or before September 15, 1994. Final payment and acceptance is desired to occur on or before September 30, 1994. 7. LIQUIDATED DAMAGES. 7.1. Provisions for liquidated damages are set forth in the Agreement. 8. SUBCONTRACTORS, SUPPLIERS, AND OTHERS. 8.1. Any Bidder so requested, shall, within 5 days after Bid opening, submit to Owner the identity of all such Subcontractors, Suppliers, and other persons and organizations proposed for those portions of the Work.
