ARTICLE 4 - REPRESENTATIONS BY CONTRACTOR A. The CONTRACTOR represents and warrants : 1 . That he is financially solvent and that he is experienced in and competent to perform the type of work or to furnish plant . materials , supplies , or equipment , to be so performed or furnished by him; and 2. That he is familiar with all ulationsFederal whichState , mayand in anyMunicipal affect�the . rules , ordinances , and reg , Work or those employed therein , including , but not limited to, any special acts relating to the Work or to the project of which it is a part; and 3. That such temporary and permanent work required by the Contract Documents as is to be done by him can be satisfactorily constructed and used for the purpose for which it is intended , and that suchand construction will not injure any person or damage any property; 4. That he has carefully examined the Drawings , Specifications , and the si to of the Work ,. as wel l as the surroundi ng terri tory , and that , f turn his own investigations , he has satisfied himself as , to the nature and location of the Work , the character, quality and quantityof surface and subsurface materials likely to be encountered , the character of equipment and other facilities needed for the performance of the Work , the general and local conditions , and all other materials which may in any way affect the Work -or its performance; and that he is not relying on any estimates , records , testsp explorations , or representations of the OWNER, the ARCHITECT , or the ENGINEER , or any agent or employee thereof. ARTICLE 5 _: SUBCONTRACTORS A. The CONTRACTOR is not to sublet any portion of the Work without the written permission of the OWNER both as to the portion to be sublet and as to the identity of the Subcontractor. B. The CONTRACTOR agrees that he is as fully responsible to the OWNER for the acts and omissions of his Subcontractors and of persons either directly or indirectly employed by him as he is for the acts and omissions of persons directly employed by him. C. Nothing contained in the ContractD� tOWNER.Documents ll create any contractual relation between any Subcontractor ARTICLE 5 - RELATIONS OF CONTRACTOR AND SUBCONTRACTOR A. The CONTRACTOR agrees to bind every Subcontractor, and every Subcontractor agrees to be bound , by the terms of the Contract , and all provisions of all Contract Documents , as far as applicable to the Work , including the following provisions of this Article.
