ARTICLE R - PROTECTION OF FORK AND PROPERTY I . A. The CONTRACTOR shall continuously maintain adequate protection of all his Work from damage and shall protect the OWNER 's property and adjacent property from injury or loss arising in connection with the Contract. He shall make good and hold the OWNER harmless from any such damage , injury or loss. He shall be held liable for all damages because of neglect to provide safeguards around all pits or excavations. CONTRACTOR shall . provide and maintain all passageways , guard fences , lights , and other i facilities for protection required by public authority or 1 oc.al condi.ti ons. f B. The CONTRACTOR shall replace or restore any tree , public .way, sewer or drain , water, gas , or other pipe , fence , or other structure interfered with by him, and not required to be permanently removed under the provisions of the Contract. C. The CONTRACTOR shall use all care. and diligence to protect the Work from damage resulting from weather, as well as carelessness , or otherwise , of ? other CONTRACTORS until his Work is accepted. Should any damage occur in spite of such protection , the OWNER will endeavor to collect from the parties at fault and pay over to the CONTRACTOR the amount of such damage , but will in no way assume responsibility' for such collection of any part thereof , as the Work is wholly at the CONTRACTOR 's risk until it has been completed and accepted. D. All .work shall be performed in a manner and at such times so as not to unnecessarily interfere with the business operations of the OWNER. ARTICLE g - OWNER 'S RIGHT TO TERMINATE EMPLOYMENT OF CONTRACTOR A. If the CONTRACTOR--should be adjudged a bankrupt; or if he should make a general assignment for the benefit of his creditors ; or if a receiver 'I should be appointed on account of his insolvency: or if he should refuse or should fail , except in cases for which extension of time is provided , to supply enough properly skilled and supervised workmen or proper materials ; or if he should fail to make prompt payment to Subcontractors or for material or labor; or disregard laws , ordinances , or the instructions of the OWNER; or otherwise be guilty of a substantial violation of any provision of the Contract, then the OWNER may, without prejudice to any other right or remedy, and after giving the CONTRACTOR, and his surety , if any , seven (7) days written notice , terminate the employment of the CONTRACTOR and take possession of the premises and of all materials , tools , and appliances thereon and finish the Work by whatever method deemed expedient. 1 . In such case , the CONTRACTOR shall not be entitled to receive any further pdyment until the Mork is finished. All provisions of the Contract shall remain in full force and effect except that the CONTRACTOR shall . not be responsible for the prosecution or quality of such portions of the Work which remain to be done after such termination. If the unpaid balance of the Contract price shall exceed the expense of finishing the Work , including compensation for I additional engineering , managerial , and administrative services , such excess shall be paid to the CONTRACTOR. If such expense shall exceed such unpaid balance , the CONTRACTOR shall pay the difference to the OWNER. Issue D GCL-6-
