ARTICLE R - PROTECTION OF FORK AND PROPERTY <br /> I . A. The CONTRACTOR shall continuously maintain adequate protection of all his <br /> Work from damage and shall protect the OWNER 's property and adjacent <br /> property from injury or loss arising in connection with the Contract. He <br /> shall make good and hold the OWNER harmless from any such damage , injury <br /> or loss. He shall be held liable for all damages because of neglect to <br /> provide safeguards around all pits or excavations. CONTRACTOR shall . <br /> provide and maintain all passageways , guard fences , lights , and other <br /> i <br /> facilities for protection required by public authority or 1 oc.al condi.ti ons. <br /> f B. The CONTRACTOR shall replace or restore any tree , public .way, sewer or <br /> drain , water, gas , or other pipe , fence , or other structure interfered <br /> with by him, and not required to be permanently removed under the <br /> provisions of the Contract. <br /> C. The CONTRACTOR shall use all care. and diligence to protect the Work from <br /> damage resulting from weather, as well as carelessness , or otherwise , of <br /> ? other CONTRACTORS until his Work is accepted. Should any damage occur in <br /> spite of such protection , the OWNER will endeavor to collect from the <br /> parties at fault and pay over to the CONTRACTOR the amount of such damage , <br /> but will in no way assume responsibility' for such collection of any part <br /> thereof , as the Work is wholly at the CONTRACTOR 's risk until it has been <br /> completed and accepted. <br /> D. All .work shall be performed in a manner and at such times so as not to <br /> unnecessarily interfere with the business operations of the OWNER. <br /> ARTICLE g - OWNER 'S RIGHT TO TERMINATE EMPLOYMENT OF CONTRACTOR <br /> A. If the CONTRACTOR--should be adjudged a bankrupt; or if he should make a <br /> general assignment for the benefit of his creditors ; or if a receiver <br /> 'I should be appointed on account of his insolvency: or if he should refuse <br /> or should fail , except in cases for which extension of time is provided , <br /> to supply enough properly skilled and supervised workmen or proper <br /> materials ; or if he should fail to make prompt payment to Subcontractors <br /> or for material or labor; or disregard laws , ordinances , or the <br /> instructions of the OWNER; or otherwise be guilty of a substantial <br /> violation of any provision of the Contract, then the OWNER may, without <br /> prejudice to any other right or remedy, and after giving the CONTRACTOR, <br /> and his surety , if any , seven (7) days written notice , terminate the <br /> employment of the CONTRACTOR and take possession of the premises and of <br /> all materials , tools , and appliances thereon and finish the Work by <br /> whatever method deemed expedient. <br /> 1 . In such case , the CONTRACTOR shall not be entitled to receive any <br /> further pdyment until the Mork is finished. All provisions of the <br /> Contract shall remain in full force and effect except that the <br /> CONTRACTOR shall . not be responsible for the prosecution or quality of <br /> such portions of the Work which remain to be done after such <br /> termination. If the unpaid balance of the Contract price shall exceed <br /> the expense of finishing the Work , including compensation for <br /> I additional engineering , managerial , and administrative services , such <br /> excess shall be paid to the CONTRACTOR. If such expense shall exceed <br /> such unpaid balance , the CONTRACTOR shall pay the difference to the <br /> OWNER. <br /> Issue D <br /> GCL-6- <br />
