ARTICLE 18 - EOUIPMENT AND TOOL USAGE CLAUSE The CONTRACTOR releases and agrees to indemnify ; hold harmless , and upon request defend the OWNER from any liability whatsoever for defects in any material , equipment or supplies loaned to the CONTRACTOR by the OWNER , whether known or unknown , and further agrees to return said property to the OWNER upon demand in as good condition as when received , ordinary wear and tear excepted. CONTRACTOR further agrees to indemnify , hold harmless and upon request defend the OWNER from all liability , loss , damage and expense resulting from any and all injury to property or persons arising out of the care , custody , control , existence , ownership, possession , operation, condition , location or use of said property and occurring between the time of the possession of said property and its return to the OWNER. ARTICLE 19 — WARRANTY A. The CONTRACTOR shall guarantee to the OWNER the items stated below. The guarantee shall be for a period of one year (or for such longer period as may otherwise by required) corrmencing on the Date of Substantial Completion of the Work or designated portion thereof (as defined in Article 7) or on the date equipment and/or facilities are placed into j service , whichever is later. 1 . All material and equipment suppl i e4 and erected against f ai lure due to workmanship , materials or methods. Failure may be evidenced by cracking , leaking , sagging , distorting , and other criteria contrary to the intent of the drawings and specifications. Replacements shall be made at the CONTRACTOR 's expense and. in accordance with original installation requirements. 2. All guarantees of suppliers and Subcontractors to CONTRACTOR shall be passed on to the OWNER without diminution or restriction , and without decreasing CONTRACTOR 's responsibility. 3. All Work will be of the best quality and satisfactory to the OWNER in every particular, and the CONTRACTOR agrees promptly and at his own expense to remedy or replace in conformity with the Contract any part of the Work which in service , proves defective or does not fully conform to the drawings and specifications. 4. CONTRACTOR 's Work shall meet all requirements of the Industrial Risk Insurers and the Associated Factory Mutual .Companies and be fully insurable by them without restriction. ARTICLE 20 - INSPECTION A. All materials and equipment used and all Work done by the CONTRACTOR shall be subject at all times to the inspection , tests , and acceptance of the OWNER. The CONTRACTOR shall furnish such samples of materials for F inspection and tests as specified or requested by the OWNER and the CONTRACTOR shall likewise furnish any information required concerning the nature or source of any materials or equipment which he proposes to use. The OWNER shall be given sufficient notice (minimum of three (3) days) to Inspect Work which will later be covered up. Issue D GCL-12-
