None of the new lots will be occupied by owner-operators <br /> or family members. <br /> ° Mr. Connolly states that the "applicant already has <br /> nine separate parcels. These parcels range in size <br /> from 23 acres to over 90 acres. There appears to <br /> be six residences on the parcels. " <br /> The owner and her daughter live at 6997 West Canal <br /> Boulevard (APN 213-090-13) . According to the <br /> application, the owner and her daughter will move <br /> to two of the homesite parcels proposed, and the son <br /> will live at the third homesite. The applicant told <br /> the Planning staff that a farm worker now lives in <br /> the existing house on Parcel 4 and will continue to <br /> live there after the subdivision. The Planning <br /> Title does not address the number of houses or <br /> parcels an owner-operator may or may not own in <br /> order to qualify to create a homesite parcel. <br /> However_ , the owner may only create one parcel for <br /> himself and one for each family member. None, of the <br /> parcels owned by the applicant were created under <br /> the homesite provisions. <br /> 2 . The required findings for approval of the Minor <br /> Subdivision cannot be made because the lots will not be <br /> owner/farmer occupied. A finding cannot be made that <br /> this subdivision is necessary to finance a residence for <br /> the owners-operator. No finding can be made that this is <br /> necessary to finance a residence for a member of the <br /> family. <br /> ° Other than Mr. Connolly"s statement, no evidence has <br /> been presented to dispute the contention that Ms. <br /> Martins is an owner-operator. <br /> Mr. Connolly is correct in arguing that the <br /> applicant has not shown the :neg:d for the proposed <br /> lots. However, there is no required finding that <br /> the proposed hemesites are necessary. Finding No. <br /> 1 states: <br /> "The proposed map is consistent with applicable <br /> General and Specific Plans. " <br /> To be consistent with the: General Plan, the <br /> applicant must meet the requirements of the <br />
