Based on evidence <br /> submitted, the applicant does comply with the <br /> requirements of the zone, and Finding No. 1 can be <br /> made. <br /> 3 . A condition in the form of a deed restriction should be <br /> required which would require merger of the parcels upon <br /> failure of the owner or family farmer to occupy. <br /> ° Merging the parcels after residences are built would <br /> be in conflict with the Planning Title, which only <br /> allows a single residence on a parcel (farm labor <br /> and second-unit dwellings are exceptions) . Once the <br /> parcel map is recorded, there is no provision to <br /> prevent the owner from selling the parcels. <br /> The San Joaquin Farm Bureau Federation offered the following <br /> comments in its letter of June 14, 1990: <br /> "The Farm Bureau is cognizant of the abuse taking place <br /> under the current Homesite Lot Split provisions. After <br /> contacting the applicant, we want to encourage the <br /> Planning Staff to scrutinize this application. The <br /> applicant should demonstrate that this is legitimate and <br /> not an abuse promoted by a realtor. For the facts to <br /> come out, it would be best to have a hearing before the <br /> Planning Commission. " <br /> The Planning staff has carefully reviewed the proposed Minor <br /> Subdivision. The applicant has not created any previous <br /> homesites under Section 9-4010. 2 . Without substantial <br /> evidence to the contrary, staff concludes that this <br /> application is a legitimate request to create homesites for <br /> the owner-operator and two family members. <br /> Flood Hazard• <br /> The project site is located in the 100-year flood zone, A-25. <br /> All new construction and substantial improvements shall meet <br /> the requirements of Section 9-10325, "Standards For Flood <br /> Hazard Reduction. " Specifically, the proposed residences are <br /> required to have the lowest floor, including the basement, <br /> elevated to at least one foot above the 100-year flood <br /> elevation. <br /> Traffic/Circulation: <br />
