SA-00-25(PRODUCE STAND CONVERSION): MR. CELLE'S <br /> REQUEST TO BE CONSIDERED AS A FARM MARKET OR VARY THE RETAIL SALES <br /> AREA SIZE REQUIREMENT FOR A SMALL AGRICULTURAL STORE TO ALLOW 500 <br /> SQUARE FEET OF RETAIL <br /> Site Approval Application No. SA-00-25 was continued from the September 7,2000, Planning Commission <br /> meeting pending the Board's approval of TA-00-5,which permits existing structures that are larger than <br /> 1,500 square feet. The applicant's existing building is approximately 2,000 square feet. <br /> The discussion at the September 7, 2000, Planning Commission public hearing indicated that there are two <br /> major issues. The areas of concern are as follows: <br /> Application Submittal and Processing Time <br /> The applicant started the Site Approval application process on March 30, 2000. The intent of the applicant <br /> was to convert a Produce Stand to a Farm Market. The applicant's representative,Mr. Joe DiCarlo,was <br /> made aware of the pending Produce Stand ordinance during this first meeting. Additionally,Mr. Celle was <br /> on the mailing list to receive draft copies of the Produce Stand Ordinance. These drafts were discussed at <br /> the public meeting that was held at the Farm Bureau in December 1999. The Produce Stand ordinance was <br /> approved by the Board of Supervisors on April 25, 2000, and it became law on May 25, 2000. <br /> Although the application was deemed complete on Tuesday, May 23, 2000,two days before the Produce <br /> Stand Ordinance became effective,another 18 days would have been needed to satisfy the mandatory 20- <br /> day CEQA review period. <br /> Conditions of Proiect Approval <br /> The applicant's legal representative originally questioned the appropriateness of the recommended <br /> conditions of project approval that were being applied to Mr. Celle's project. Subsequent discussions with <br /> the Community Development department identified the applicant's desire to be treated the same as other <br /> Produce Stands who have already converted to Farm Markets. As long as the other Produce Stands who <br /> have become Farm Markets are adhering to their conditions of approval,the applicant is agreeable to the <br /> conditions placed on his project. <br />
