As stated in the fourth paragraph of the approval letters, <br /> all conditions of approval need to be met before any new use is established. Both of the previously <br /> approved Produce Stand conversions will need to suspend selling sundries until the Improvement plan is <br /> submitted. <br /> With one exception,the same conditions of approval were applied to the other two previously approved <br /> Produce Stand conversion applications(SA-99-61 and SA-00-13). The conditions of approval for SA-99-61 <br /> and SA-00-13 were silent in regards to outdoor seating. <br /> Mr. Celle's application,which was reviewed as the first Small Ag Store application to be processed,was <br /> conditioned to exclude outdoor seating as part of the project approval.This condition should be removed in <br /> order to bring all of the Produce Stand conversions into parity. <br /> • Options <br /> The applicant has several options to consider. _ <br /> 1. Continue with the Small Ag store application and have 150 sq ft of retail area as permitted by the <br /> current Development Title;or <br /> 2. Resubmit the application as a Use Permit for a Large Ag store and have 500 sq ft of retail area;or <br /> 3. Cease selling items other than produce and retain the current status of a Produce Stand. <br /> As noted at the hearing, County Counsel held that after the effective date of the Produce Stand ordinance <br /> (May 25, 2000), Mr. Celle's application could no longer be considered as a conversion to a Farm Market. <br /> KS/TF/blm <br /> Attachment <br />
