CONDITIONS OF APPROVAL <br /> SA-97-53 <br /> Fetzer <br /> Site Approval Application No. SA-97-53 was approved by the San Joaquin County Planning <br /> Commission on February 5, 1998. The effective date of approval is February 15, 1998. This approval <br /> will expire on April 16, 1998 , which is 60 days from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have be-_,n <br /> secured and remain in force for Phase 1, and (3) all necessary permits from other agencies have <br /> been secured and remain in force for Phase 1. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kerry Sullivan,468-3140) <br /> a. BUILDING PERMIT: Submit a "Commercial Building Permit' application. The Site Plan <br /> required as a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage,driveway access details(including gates), <br /> on-site parking, landscaping,signs, existing and proposed utility services,and grading(refer <br /> to the "Site Plan Check List" for details). A fee is required for the Site Plan review. <br /> (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a church with accessory retail sales of used items in <br /> an existing building, as shown on the Site Plan submitted December 12, 1997. Expansion <br /> beyond Phase 1 (66 people)to a maximum of 250 people shall be allowed upon completion <br /> of Phases 2 and 3. There shall be no outside storage or sales permitted as part of this <br /> approval. Phases 2 and 3 shall be completed within 5 years of the approval date. <br /> C. COMPLIANCE DATE: Because this development is currently operating without the <br /> required permits,the Site Plan shall be submitted within 60 days from the date of the project <br /> approval. Enforcement action will be deferred if the Site Plan is submitted within 60 days <br /> and all of the Conditions of Approval relative to Phase 1 are met within 60 days. <br /> d. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to <br /> the initiation of the use. The Business License may be applied for concurrently with the <br /> building permit application. (County Ordinance Code Section 7-1000) <br /> e. PARKING: Off-street parking shall be provided and comply with the following: <br /> (1) All parking spaces, driveways, and maneuvering areas shall be surfaced and <br /> permanently maintained with base material of appropriate depth and asphalt <br /> concrete or Portland cement concrete to provide a durable, dust-free surface. <br /> Bumper guards shall be provided where necessary to protect adjacent structures or <br /> properties. (Development Title Section 9-1015.5) <br /> (2) Phase 1 shall contain a minimum of 21 spaces, Phase 2 shall contain a minimum <br /> total number of 44 spaces,and Phase 3 shall contain a minimum total number of 83 <br /> spaces, including 4 accessible spaces. The accessory retail use may use the <br /> Conditions of Approval - 1 - SA-97-53 <br />
