E1 Dorado Street ) and 33459 et . seq. <br /> Stockton, California 95202 ) <br /> I . INTRODUCTION. <br /> 1 . 1 Parties . The California Environmental Protection <br /> Agency, Department of Toxic Substances Control ( "DTSC" ) and the <br /> Stockton Redevelopment Agency ( "Agency" ) enter into this <br /> Oversight and Consultation Agreement ( "Agreement" ) . <br /> 1 . 2 Site . The property which is the subject of this <br /> Agreement ( "Site" ) includes the following area located in <br /> Stockton, San Joaquin County, California : All of the real <br /> property, including Lindsay Street, lying north of the Stockton <br /> Deep Water Channel and south of Fremont street, between Harrison <br /> Street and Madison Street; but excluding the block bounded by <br /> Harrison Street , Fremont Street, Lincoln Street and Lindsay <br /> Street . The Site properties described above are identified by <br /> Assessor Parcel Number (s) 137-010-04 ; 137-230-01 ; 137-230-02 ; <br /> 137-230-03 ; 137-230-04 ; 137-230-05 ; 137-230-06 ; 137-240-02 ; 137- <br /> 240-04 ; and, 137-250-20 . A map of the Site and a location map <br /> are attached as Exhibit A and Exhibit B . <br /> 1 . 3 Jurisdiction. DTSC and the Agency enter into this <br /> Agreement pursuant to the Polanco Redevelopment Act, Health and <br /> Safety Code ( "H&SC " ) section 33459 et . seq. , which authorizes a <br /> redevelopment agency to take any actions that the agency <br /> determines are necessary to assess, evaluate, investigate, <br /> monitor, remove, correct, cleanup or abate a release of hazardous <br /> substances on, under, or from property within a project area, <br /> pursuant to cleanup guidelines to be requested from DTSC, and <br /> under the oversight of DTSC, for which the Agency shall reimburse <br /> DTSC. DTSC and the Agency also enter into this Agreement <br /> pursuant to H&SC section 25355 . 5 . This section authorizes DTSC <br /> to enter into an enforceable agreement with a proponent to <br /> oversee the characterization and cleanup of a Site . <br /> 1 <br />
