1 . 4 Purpose . The purpose of this Agreement is for the <br /> Agency to prepare site investigation documents and, if necessary, <br /> a remedial action plan, and implement remedial measures at the <br /> Site. For this Site, the initial site investigation report will <br /> be a Preliminary Endangerment Assessment report which is the <br /> basis for the initial scope of work of this Agreement . <br /> This Agreement is also to provide for (1) DTSC' s <br /> consultation and review of site investigation and remedial action <br /> plan documents and implementation documents submitted by the <br /> Agency or its consultant consistent with the Scope of Work <br /> described in Exhibit C and (2) DTSC to obtain reimbursement from <br /> the Agency for costs incurred by DTSC in regards to DTSC' s <br /> oversight of this project . The parties recognize and acknowledge <br /> that notwithstanding this Agreement one or more entities that are <br /> not party to this Agreement (a "Responsible Party" or <br /> collectively the "Responsible Parties") may agree with the Agency <br /> pursuant to H&SC section 33459 . 1 to implement the remedial <br /> measures proposed by the Agency and approved by DTSC. <br /> II . BACKGROUND <br /> 2 . 1 Ownership. A schedule identifying the current site <br /> ownership is attached as Exhibit D. <br /> 2 . 2 Substances Found at the Site . At Banner Island, <br /> underground and aboveground storage tanks have been removed. <br /> Soil samples indicate the presence of petroleum hydrocarbons, <br /> lead, benzene, arsenic and mercury. The area west of Banner <br /> Island between Lindsay Street and the Deep Water Channel <br /> apparently has not been tested. <br /> At the Crystal Creamery block, ground water monitoring <br /> indicates the presence of a petroleum hydrocarbon plume . A <br /> 10 , 000-gallon unleaded gasoline underground storage tank was <br /> apparently removed from the property in 1986 . Underground <br /> storage tanks have been removed from the Chase West block. <br /> Ground water monitoring indicates the presence of a petroleum <br /> hydrocarbon plume which appears to be independent of the Crystal <br /> Creamery block plume . At the Chase East block, several storage <br /> tanks have been removed which contained gasoline and at least one <br /> which contained the solvent trichloroethane (TCA) . Ground water <br /> monitoring indicates the presence of petroleum hydrocarbons and <br /> the presence of chlorinated solvents around the location of the <br /> former TCA tank. <br /> 2 . 3 Physical Description and Site History. The easterly <br /> portion of the area between Lindsay Street and the Deep Water <br /> Channel is commonly referred to as Banner Island. It was the <br /> location of former shipbuilding, repair and equipment <br /> manufacturing facilities operated by Ronald M. Guntert, Sr. , and <br /> the Guntert Companies . This site was razed when the facilities <br /> were relocated in the 1980s and is now vacant . Historically, the <br /> Deep Water Channel was a point of access for ship and vessel- <br /> 2 <br />
