Land Use (Workbook; page 24) <br /> ---------------------------------------------------------------------------------------------------------------------------------- <br /> Description of Environmental Setting <br /> The Site is lies within the City of Stockton's Downtown Redevelopment Zone and is zoned for <br /> industrial/commercial land use. The proposed selected remedial action objective requires that an <br /> institutional control in the form of a land use covenant be filed by the City of Stockton to restrict <br /> specific land uses that may not be protective of public health due to the residual contamination. <br /> However, the land use restrictions will not hamper redevelopment plans since the restricted site <br /> activities will only include prohibitions on construction of residences, hospitals, daycare centers, and <br /> schools for persons under 21 years of age as well as raising food and construction of wells for <br /> potable sources. Once a specific project is identified, the City of Stockton will need to prepare the <br /> necessary environmental reports in compliance with CEQA requirements, which will reference the <br /> RAP. Prior to construction activities, a separate Health and Safety Plan will be prepared in <br /> compliance with Title 29 of the Code of Federal Regulations Part 1910.120 adopted by the California <br /> Occupational Safety and Health Administration. Language in the deed restriction will refer to a soils <br /> management plan, and associated health and safety plan, that which will provide future developers <br /> the specific details regarding the contamination, compliance with regulations, and procedures to <br /> confirm to the satisfaction of DTSC that the remedial action has been completed.
