APPLOATION - VARIANCE <br /> SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT <br /> The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts In the case of this application <br /> support each of the findings. These findings that you provide will be Included with the Staff Reports that are distributed to members at the <br /> Planning Commission. <br /> 1. Because of the special circumstances applicable to the property,including size,shape, topography,location or surroundings, the <br /> strict application of the zoning regulations deprives the property of privileges enjoyed by othor properties in the vicinity and under <br /> Identical zoning classification. <br /> THE SUBJECT PROPERTY IS LOCATED DIRECTLY TO THE SOUTH OF WESTON RANCH. THE PROPERTY IS CURRENTLY BEING <br /> FARMED, GROWING ASPARAGUS AND TOMATOES. THE REQUEST FOR VARIANCE IS TO MINIMIZE THE IMPACT A MAJOR <br /> ARTERIAL 750 NEW HOUSES AND A NEW HIGH SCHOOL WILL HAVE ON THE PROPERTY. OUR REQUEST IS ALSO TO MTNIMTZE <br /> THE IMPACT OF THE LOSS OF THIRTY FEET OF PROPERTY TO THE CURRENT IRRIGATION SYSTEM. CURRENTLY, COUNTY <br /> ORDINANCES ALLOW FOR CHAIN LINK FENCES TO BE PLACED ON PROPERTY LINES. THE SOLID FENCE REQUESTED IS <br /> TEMPORARY AND WILL BE REMOVED AND REPLACED,IF REQUIRED, BY FUTURE DEVELOPMENT ON THE SUBJECT PROPERTY. <br /> 2. The granting of the Variance will not constitute a grant of special privileges Inconsistent with the limitations upon other properties In <br /> the vicinity and zone in which the property is situated. <br /> THE REQUEST IS UNUSUAL DUE TO THE PROXIMITY OF NEW DEVELOPMENT AND THE NEED TO PROTECT THE PROPERTY. SINCE <br /> THE FENCE IS TEMPORARY GRANTING SUCH VARIANCE WILL NOT CONSTITUTE A SPECIAL PRIVILEGE, PENDING APPROVAL <br /> OF FUTURE DEVELOPMENT ALL CITY AND/OR COUNTY ORDINANCES WILL BE COMPLIED WITH. <br /> 3. The Variance will not authorize a use or activity which Is not otherwise expressly authorized by the zone regulation governing the <br /> parcel of property. <br /> THE VARIANCE WILL ALLOW FOR A CONTROLLED SEPARATION BETWEEN DEVELOPMENT AND AGRICULTURE. THE PROPERTY IS <br /> CURRENTLY ZONED AG-40 AND IS IN THE WILLIAMSON ACT. THERE ARE NO PLANS FOR FUTURE DEVELOPMENT.
