This water has not been analyzed <br /> to determine if it is hazardous or not. <br /> V. Observations <br /> Mr. Kelly gave us a tour through the facility. During this tour, lie <br /> demonstrated how the accumulated water in the gasoline storage tank is <br /> discharged into the tank farm. No visible gasoline was noted in the <br /> effluent water. Also, no discolored soil was noted inside the tank <br /> farm or on other parts of the facility. In general, the housekeeping <br /> at the facility was good. <br /> VI. Violations <br /> A. Title 40, Code of Federal Regulations (40 CFR) <br /> 1 . Section 262.11 - MOC failed to make a hazardous waste deter- <br /> mination (rinsewater from the loading rack and accumulated <br /> water in the petroleum tanks) . <br /> 2. Section 262.34(b) - MOC is operating an onsite hazardous waste <br /> storage facility without a hazardous waste permit and without <br /> complying with the requirements of 40 CFR, Parts 264 and 265 <br /> and the permit requirements of 40 CFR, Part 122. <br /> 3. Section 262.41 - MOC failed to submit annual reports as required. <br /> 4. Section 262.34(a) - MOC failed to remove hazardous waste from <br /> the facility for proper disposal or recycling within 90 days <br /> of its generation of this waste. <br /> 5. Section 265. 16 - MOC failed to provide personnel with training <br /> in hazardous waste management procedures and failed to maintain <br /> documents and records of such training at the facility as required. <br /> 6. Section 265.33 - MOC failed to maintain or test its emergency <br /> equipment to make sure that they are in operable condition. <br /> 7. Section 265.37 - MOC failed to make arrangements with the local <br /> police department, fire department, hospital, contractors, and <br /> state or local emergency response teams to coordinate an emergency. <br /> 8. Section 265.52 - MOC failed to prepare a list of all the emer- <br /> gency equipment in the facility. MOC also failed to prepare an <br /> evacuation plan for the facility personnel in case of an emergency. <br />
