i <br /> I State of California and confined to Defendant's TRUCK REPAIR AD TRUCK WASH activities in <br /> 2 the County of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they <br /> 4 are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br /> 5 TRUCK WASH activities, are pursuant to Health and Safety Code section 25181 hereby <br /> 6 permanently enjoined from: <br /> 7 a. Failing to obtain and keep on file at the facility a written assessment reviewed and <br /> 8 certified by an independent, qualified,professional engineer attesting that the hazardous waste tank <br /> 9 and containment system has sufficient structural integrity, in violation of California Code of <br /> 10 Regulations,title 22 section 66265.192; <br /> 11 b. Failing to completely label or mark each container or portable tank used for onsite <br /> 12 accumulation of hazardous waste,in violation of California Code of Regulations,title 22 section <br /> 13 66262.34(f); <br /> 14 c. Treating, storing,disposing of,transporting or offering to transport hazardous <br /> 15 waste without having an Identification Number, in violation of California Code of Regulations,title <br /> 16 22 section 66262.12(a); <br /> 17 d. Failing to determine if that waste is a hazardous waste, in violation of California <br /> 18 Code of Regulations,title 22 section 66262.11; <br /> 19 e. Failing to train personnel within six(6)months after the date of their employment <br /> 20 or assignment to a facility, or to a new position at a facility, in violation of California Code of <br /> 21 Regulations,title 22 section 66265.16(b); <br /> 22 f. Failing to keep training records on current personnel until the closure of the facility <br /> 23 and/or on former employees for at least three (3)years from the date the employee last worked at the <br /> 24 facility, in violation of California Code of Regulations,title 22 section 66265.16(e); <br /> 25 g. Failing to document an inspection in the operating record of the facility, in <br /> 26 violation of California Code of Regulations,title 22 section 66265.195(c); <br /> 27 h. Failing to maintain and operate facility to minimize the possibility of a fire, <br /> 28 explosion, or any unplanned sudden or non-sudden release of hazardous waste,in violation of <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
