i I State of California and confined to Defendant's TRUCK REPAIR AD TRUCK WASH activities in 2 the County of San Joaquin and elsewhere in the State of California. 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they 4 are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND 5 TRUCK WASH activities, are pursuant to Health and Safety Code section 25181 hereby 6 permanently enjoined from: 7 a. Failing to obtain and keep on file at the facility a written assessment reviewed and 8 certified by an independent, qualified,professional engineer attesting that the hazardous waste tank 9 and containment system has sufficient structural integrity, in violation of California Code of 10 Regulations,title 22 section 66265.192; 11 b. Failing to completely label or mark each container or portable tank used for onsite 12 accumulation of hazardous waste,in violation of California Code of Regulations,title 22 section 13 66262.34(f); 14 c. Treating, storing,disposing of,transporting or offering to transport hazardous 15 waste without having an Identification Number, in violation of California Code of Regulations,title 16 22 section 66262.12(a); 17 d. Failing to determine if that waste is a hazardous waste, in violation of California 18 Code of Regulations,title 22 section 66262.11; 19 e. Failing to train personnel within six(6)months after the date of their employment 20 or assignment to a facility, or to a new position at a facility, in violation of California Code of 21 Regulations,title 22 section 66265.16(b); 22 f. Failing to keep training records on current personnel until the closure of the facility 23 and/or on former employees for at least three (3)years from the date the employee last worked at the 24 facility, in violation of California Code of Regulations,title 22 section 66265.16(e); 25 g. Failing to document an inspection in the operating record of the facility, in 26 violation of California Code of Regulations,title 22 section 66265.195(c); 27 h. Failing to maintain and operate facility to minimize the possibility of a fire, 28 explosion, or any unplanned sudden or non-sudden release of hazardous waste,in violation of -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
