I California Code of Regulations,title 22 section 66265.31; <br /> 2 i. Failing to keep container holding hazardous waste closed during transfer and <br /> 3 storage, except when it is necessary to add or remove waste, in violation of California Code of <br /> 4 Regulations, title 22 section 66265.173(x); <br /> 5 j. Failing to mark and manage an emptied container or an inner liner from a container <br /> 6 larger than five (5) gallons in capacity, in violation of California Code of Regulations,title 22 section <br /> 7 66261.7(f); <br /> 8 k. Failing to transfer hazardous waste in a container not in good condition to a <br /> 9 container that is in good condition, in violation of California Code of Regulations, title 22 section <br /> 10 66265.171; and <br /> 11 1. Disposing or causing the disposal of a hazardous or extremely hazardous waste at a <br /> 12 point which is not authorized, in violation of Health and Safety Code section 25189(d). <br /> 13 4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br /> 14 are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br /> 15 TRUCK WASH activities, are pursuant to Health and Safety Code section 25515.6 hereby <br /> 16 permanently enjoined from: <br /> 17 a. Failing to implement, maintain or to submit to the unified program agency, a <br /> 18 complete hazardous materials business plan, in violation of Health and Safety Code sections 25505 <br /> 19 and 25508, and California Code of Regulations,title 19 section 2729; <br /> 20 b. Failing to implement and maintain a business emergency plan for emergency <br /> 21 response to a release or threatened release of hazardous materials, in violation of Health and Safety <br /> 22 Code section 25507; and <br /> 23 c. Failing to implement,maintain and comply with, an employee training program, in <br /> 24 violation of Health and Safety Code section 25505(a)(4), and California Code of Regulations,title 19 <br /> 25 section 2732. <br /> 26 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 27 are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br /> 28 TRUCK WASH activities, are pursuant to California Business and Professions Code, section 17204 <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
