Failing to withdraw ladders that have developed defects from service for repair or <br /> 2 destruction; and tag or mark as "Dangerous,Do Not Use"or with similar language, in violation of <br /> 3 California Code of Regulations,title 8 section 3276(e)(3); <br /> 4 m. Failing to use work rests on offhand grinding machines to support the work, in <br /> 5 violation of California Code of Regulations,title 8 section 3577(e); <br /> 6 n. Failing to provide or require hand protection for employees whose work involves <br /> 7 unusual and excessive exposure of hands to cuts, burns,harmful physical or chemical agents or <br /> 8 radioactive materials, in violation of California Code of Regulations,title 8 section 3384(a); <br /> 9 o. Operating an air tank without obtaining a permit to operate, in violation of <br /> 10 California Code of Regulations, title 8 section 461; <br /> 11 p. Failing to store cylinders of compressed gas in areas where they are protected from <br /> 12 external heat sources such as flame impingement, intense radiant heat, electric arc,or high <br /> 13 temperature steam lines, in violation of California Code of Regulations,title 8 section 4650; <br /> 14 q. Failing to ensure ready availability of medical personnel for advice and <br /> 15 consultation on matters of industrial health or injury, in violation of California Code of Regulations, <br /> 16 title 8 section 3400; and <br /> 17 r. Failing to provide plumbed or self-contained eyewash or eye/facewash equipment <br /> 13 which meets the requirements of sections 5, 7, or 9 of ANSI Z358.1-1981, Emergency Eyewash and <br /> 19 Shower Equipment,incorporated herein by reference,at all work areas where, during routine <br /> 20 operations or foreseeable emergencies,the eyes of an employee may come into contact with a <br /> 21 substance which can cause corrosion, severe irritation or permanent tissue damage or which is toxic <br /> 22 by absorption, in violation of California Code of Regulations,title 8 section 5162. <br /> 23 6. Defendants shall pay to Plaintiff the sum of FIFTEEN THOUSAND DOLLARS <br /> 24 $15,000.00, as and for civil penalties,pursuant to Health and Safety Code §25192, as follows: <br /> 25 a. $ 7,500.00 made payable to the DEPARTMENT OF TOXIC SUBSTANCE <br /> 26 CONTROL—TOXIC SUBSTANCE CONTROL ACCOUNT, as per the following payment <br /> 27 schedule: <br /> 24 $ 3,000.00—On or before JULY 1,2017 <br /> -5— <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
