1 <br /> 1 $ 3,000.00—On or before JULY 1,2018 <br /> 2 $ 1,500.00—On or before JULY 1,2019 <br /> 3 b. $ 3,750.00 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 4 HEALTH DEPARTMENT—ENVIRONMENTAL HEALTH DIVISION TRUST, as per the <br /> 5 following payment schedule: <br /> 6 $ 1,500.00—On or before JULY 1,2019 <br /> 7 $ 2,250.00—On or before JULY 1,2020 <br /> 8 c. $ 3,750.00 made payable to the SAN JOAQUIN COUNTY OFFICE OF THE <br /> 9 DISTRICT ATTORNEY, as per the following payment schedule: <br /> 10 $ 750.00—On or before JULY 1,2020 <br /> 11 $ 3,000.00—On or before JULY 1, 2021 <br /> 12 Said payments shall be delivered to the San Joaquin County Office of the District Attorney, <br /> 13 Environmental Prosecutions Unit. <br /> 14 7. Defendant shall be penalized, as and for civil penalties,pursuant to Business and <br /> 15 Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6, <br /> 16 ONE HUNDRED THOUSAND DOLLARS ($100,000.00). However, it is stipulated by all parties <br /> 17 that the entire additional ONE HUNDRED THOUSAND DOLLARS ($100,000.00), in civil <br /> 18 penalties shall be stayed for a period of seven(7)years on the following conditions: <br /> 19 a. Defendant will not violate Health and Safety Code sections 25100 et seq., as <br /> 20 described in paragraph 3 above; <br /> 21 b. Defendant will not violate Health and Safety Code sections 25500 et seq., as <br /> 22 described in paragraph 4 above; <br /> 23 c. Defendant will not violate or engage in any of the unlawful acts of unfair <br /> 24 competition as specifically set forth in the First, Second, and Third Causes of Action of the <br /> 25 Complaint filed in this action. <br /> 26 8. The ONE HUNDRED THOUSAND DOLLARS ($100,000.00)in civil penalties, <br /> 27 described in paragraph 7 above, shall immediately be due and payable as set forth in paragraph 7 <br /> 28 above, if the San Joaquin County Office of the District Attorney files Declarations that Defendant <br /> -6- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
