I violated Health and Safety code sections 25280 et seq., or Health and Safety Code sections 25100 et <br /> 2 seq. or Business and Professions Code sections 17200 et seq., as described in paragraphs 3, 4, and 5 <br /> 3 above. Any penalties or other relief sought by Plaintiff for such violations or alleged violations shall <br /> 4 be sought by noticed motion. Plaintiff shall notify Defendant in writing of such alleged violations <br /> 5 and shall meet and confer with Defendant within twenty (20) business days of such written notice <br /> 6 prior to filing any such motion. The Parties shall negotiate in good faith in an effort to resolve any <br /> 7 fiu-ther penalty assessments or other relief pursuant to this paragraph without judicial intervention. <br /> 8 Defendant reserves all defenses in law and equity. <br /> 9 9. If all the conditions listed in paragraph 7 above are met,then seven (7)years from the <br /> 10 filing date of this document, the stayed penalty shall be dismissed. <br /> 11 10. Defendant shall additionally pay to Plaintiff the sum of SEVEN THOUSAND FOUR <br /> 12 HUNDRED SIXTY-SIX DOLLARS AND FIFTY-FIVE CENTS ($7,466.55) as partial recovery of <br /> 13 the cost of investigation and suit incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 14 HEALTH DEPARTMENT. Said payment shall be due and payable to the aforementioned agency, <br /> 15 and shall be delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 16 Prosecutions Unit, on or before JULY 1, 2016. <br /> 17 11. Defendant shall additionally pay to Plaintiff the sum of SIX THOUSAND FIVE <br /> 18 HUNDRED THIRTY-THREE DOLLARS AND FORTY-FIVE CENTS ($6,533.45) as partial <br /> 19 recovery of the cost of investigation and suit incurred by the San Joaquin County Office of the <br /> 20 District Attorney. Said payment shall be due and payable to the aforementioned agency, and shall be <br /> 21 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> 22 Unit, on or before JULY 1, 2017. <br /> 23 12. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br /> 24 proceeding in the Superior Court. The amount of the filing fee is FOUR HUNDRED THIRTY-FIVE <br /> 25 DOLLARS ($435.00). Said payment shall be made payable to the SAN JOAQUIN COUNTY <br /> 26 SUPERIOR COURT and delivered to the San Joaquin County Office of the District Attorney, <br /> 27 Environmental Prosecutions Unit, at time of signing. <br /> 28 13. This Judgment shall go into effect immediately upon entry hereof. Entry is authorized <br /> -7- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
