As we discussed, Pet Incorporated recently purchased <br /> all of the stock of Progresso Foods Company. Progresso Foods Company <br /> owns the former Tillie Lewis cannery in Stockton, California. A <br /> leaking underground storage tank was recently discovered on this <br /> property. Extensive engineering studies conducted by McClelland <br /> Engineers , as subcontractors, to Ogden Environmental Services, <br /> Progresso's prime contractor for renwdiating this site, resulted in <br /> the preparation of the Final Remedial Plan for Former Tillie Lewis <br /> Foods Cannery, Stockton, California, which formed the basis for the <br /> meeting on May 26 in your office. The remainder of this letter will <br /> confirm the agreements reached during this meeting. <br /> It was agreed that Progresso and Ogden Environmental Services can <br /> proceed imnediately to implement the Final Remedial Plan. This <br /> implementation, however, is subject to the following. <br /> 1. Ogden Environmental shall receive written verification from <br /> the California Department of Health Services stating that a <br /> variance to required permitting is applicable on this site <br /> due to the unique site circumstances including the type of <br /> contamination and local regulatory oversight being exercised <br /> by the San Joaquin County Air Pollution Control District. <br /> 2. Ogden Environmental shall receive a permit for operation of a <br /> thermal treatment unit from the San Joaquin County Air <br /> Pollution Control District. <br /> 3. Ogden Environmental shall receive approval , if any is <br /> necessary, from the City of Stockton Planning Department <br /> related to a conditional use permit for installation and <br /> operation of a thermal treatment unit. <br />
