In addition, Richard Keffer and I spoke <br /> to you by telephone on June 3, 1988. As we discussed, Pet <br /> Incorporated recently purchased all of the stock of Progresso <br /> Foods Company. Progresso Foods Company owns the former Tillie <br /> Lewis cannery in Stockton, California. A leaking underground <br /> storage tank was recently discovered on this property. Extensive <br /> engineering studies conducted by McClelland Engineers, as <br /> subcontractors, to Ogden Environmental Services , Progresso's <br /> prime contractor for remediating this site,- resulted in the <br /> preparation of the Final Remedial Plan for Former Tillie Lewis <br /> Foods Cannery, Stockton, California (hereinafter referred to as <br /> the "Remediation Plan") , which formed the basis for the meeting <br /> on May 26 in your office. The remainder of this letter will <br /> confirm the agreements reached during our recent meeting and <br /> follow-up telephone conversation. <br /> It was agreed that Progresso and Ogden Environmental Services can <br /> proceed immediately to implement the Remediation Plan. This <br /> implementation, however, is subject to the following. <br /> 1. Ogden Environmental shall receive written verification <br /> from the California Department of Health Services <br /> stating that a variance to required permitting is <br /> applicable on this site due to the unique site <br /> circumstances including the type of contamination and <br /> local regulatory oversight being exercised by the San <br /> Joaquin County Air Pollution Control District. <br /> 2. Ogden Environmental shall receive a permit for operation <br /> of a thermal treatment unit from the San Joaquin County <br /> Air Pollution Control District. <br /> General Offices at Pet Plaza 400 South Fourth Street Sl.
