Ogden Environmental shall receive approval, if any is <br /> necessary, from the City of Stockton Planning <br /> Department related to a conditional use permit for installation and <br /> operation of a thermal treatment unit. <br /> 4. Ogden Environmental shall provide to you and Laurie <br /> Cotulla duplicates of all sample analyses provided to the <br /> local sewer district of the water pumped from the water <br /> pumping wells ringing the excavation area. <br /> 5. Ogden Environmental shall obtain local permits for and <br /> shall install and monitor water wells alongside the north <br /> property line of the former Tillie Lewis cannery in order to <br /> monitor any possible influx of solvents or other <br /> contamination from the Carnation Company site located <br /> across the street from the north boundary of the Tillie Lewis <br /> cannery. <br /> 6. Ogden Environmental shall obtain local permits for and <br /> shall install and monitor extraction/dewatering wells in an <br /> area surrounding the excavation site as described in the <br /> Remediation Plan. <br /> 7. The procedure for ascertaining that all contamination has <br /> been removed from the soil and water will be an on-site <br /> inspection and split soil and water sampling conducted by <br /> either the CVRWQCB or San Joaquin Local Health District <br /> using GCFID and EPA Method No. 8020 or 8240. If the <br /> split samples reveal contamination, the CVRWQCB will <br /> issue a letter describing the conditions remaining at the site and <br /> whether or not further remediation is necessary. If the sampling <br /> procedures were adequate and the split samples reveal no <br /> contamination, the CVRWQCB will issue a letter to Progresso <br /> Foods Company stating that all contamination has been removed, <br /> and that no additional sampling or remediation of contamination <br /> resulting from the leaking underground storage tank described in <br /> the Remediation Plan will be required. <br /> If you have any questions regarding this description of our <br /> agreement, please contact me.
