As far as Tim knows , Rhyland Homes has not applied for a waiver or a permit for their construction dewatering to a pond and re - application by spray to land . Since there appears to be a connection between the pumping for the dewatering and the lowering of water levels from 9 ' bgs to 19 ' bgs at the UST site across the street , Tim said that the waiver would not be applicable as there may be groundwater polluting in the discharge . If true , then the discharger is out of compliance with the Water Code and may be subject to fines up to $ 1 , 000 per day or $ 10 per gallon discharged . They need to contact us for Waste Discharge Requirements immediately and stop the discharge until we can evaluate a Report of Waste Discharge ( data ) . I also spoke with Rob Busby on the matter .
