Furry Road <br /> Lodi, CA 95240 <br /> CALIFORNIA WATER CODE SECTION 13267 ORDER FOR TECHNICAL REPORTS AND <br /> REVISED MONITORING AND REPORTING PROGRAM NO. 71-37,BEAR CREEK WINERY, <br /> SANJOAQUIN COUNTY <br /> On 10 December 2002, tentative Waste Discharge Requirements (WDRs) for Goldstone Land Company, <br /> Kurt Kautz, and Bear Creek Winery were distributed for comments. On 31 January 2003,Fall Creek <br /> Engineering (FCE)provided comments on the tentative WDRs. Because FCE raised issues that could <br /> not be resolved without further investigation, staff removed the tentative WDRs from the agenda and <br /> agreed to allow further studies to be performed prior to revising and resubmitting the tentative WDRs for <br /> consideration by the Regional Board. <br /> Issues raised by FCE include uncertainties of background groundwater quality, pH neutralization of <br /> wastewater prior to application to the land treatment units, the level of source control already <br /> implemented by the winery, and effluent limits related to the water supply quality. The reports <br /> described below are required pursuant to Section 13267 of the California Water Code. It should be <br /> noted that all these reports were required in the tentative WDRs and that neither Bear Creek Winery nor <br /> FCE raised objections to completing the work. <br /> To facilitate collection of monitoring data while the technical reports are being prepared and studies are <br /> performed, this order also includes a revised Monitoring and Reporting Program (MRP)No. 71-37. The <br /> revised MRP includes the additional analytes for winery wastewater, supplemental irrigation water, and <br /> groundwater that FCE recommended in their 31 January 2003 comment letter. The revised MRP is <br /> issued pursuant to California Water Code Section 13267. <br /> Section 13267 of the California Water Code in part states: <br /> (b) (1)In conducting an investigation specified in subdivision (a), the regional board may <br /> require that any person who has discharged, discharges, or is suspected of having <br /> discharged or discharging, or who proposes to discharge waste within its region, or any <br /> citizen or domiciliary, or political agency or entity of this state who has discharged, <br /> discharges, or is suspected of having discharged or discharging, or who proposes to <br /> discharge, waste outside of its region that could affect the quality of waters within its region <br /> California Environmental Protection Agency <br /> co Recycled Paper <br /> The energy challenge facing California is real.
