The ROWD was submitted on <br /> 29 December 2014 and a revised ROWD was submitted on 30 April 2015. with the intention to <br /> update Waste Discharge Requirements (WDRs) 71-37, which was adopted on 21 August 1970. <br /> As a result of the discussion, two issues require further clarification, including California <br /> Environmental Quality Act (CEQA) documentation and the proposed improvement schedule in <br /> the ROWD. This letter is provided to document our discussion and issues of concern as revised <br /> WDRs are developed for discharge to land at the facility. <br /> CEQA <br /> The proposed improvements to the wastewater system outlined in the ROWD includes <br /> installation of a new wastewater treatment pond and tricking system, and expansion of vineyard <br /> land application areas (LAAs) from the current 38 acres to 185 acres. Our 5 March 2015 <br /> Incomplete ROWD letter requested the winery to submit a CEQA document for the proposed <br /> facility improvements. In response, the winery submitted a Negative Declaration dated <br /> 2 February 1999, for a Use Permit Application to expand the winery. The Use Permit <br /> Application referred to the winery as consisting of Assessor Parcel Numbers 061-160-002, <br /> 061-160-025, and 061-160-026. This list of parcel numbers is inconsistent with the parcel <br /> numbers referenced in the recently submitted Form 200 with the ROWD, (APN 061-160-002, <br /> 061-160-006, 061-160-025, and 061-140-054). Additionally, the configuration of winery <br /> buildings proposed on a Master Site Plan in the 1999 Use Permit Application is different than <br /> the current facility layout. <br /> Because of these discrepancies and that the 1999 Use Permit Application does not include all <br /> current and planned parcels to be used for Land Application Areas, Central Valley Water Board <br /> staff believes that the proposed improvements will significantly change the nature of wastewater <br /> disposal and it should be considered a project, as defined by CEQA. Therefore a CEQA <br /> document must be prepared for the public review and be adopted by the lead agency San <br /> Joaquin County Community Development Department. Preparation of an Initial Study and <br /> public review should not interfere with adoption of WDRs during our February 2016 Board <br /> hearing, provided that an approved Negative Declaration is received by 1 January 2016. <br /> KARL E.
