The <br /> permission requirement would be met by way of a permit or formal agreement between the <br /> project proponent and DWR. <br /> DWR has a drainage easement in the area of the proposed project. The proposed retention <br /> basin may be located within DWR's drainage easement. Any portion of the proposed <br /> retention basin which would be located within DWR's easement would require an <br /> encroachment permit from DWR. <br /> X. Hydrology and Water Quality <br /> The IS/MND does not analyze the proposed project's potentially significant impacts to the <br /> Aqueduct's existing drainage patterns and DWR's drainage easement rights. <br /> DWR requests the lead agency include in the CEQA record the impact analysis for the <br /> hydrology and water quality section prior to the adoption of this project's MND. Specifically, <br /> DWR requests the lead agency provide the impact analysis for the proposed project's <br /> grading, paving, and proposed drainage patterns on the Aqueduct's drainage patterns and <br /> DWR's drainage easement. <br /> To minimize the proposed project's hydrology impacts and facilitate DWR's permission <br /> process, DWR suggests the proposed project's retention basin discharges be directed to the <br /> pipe overchute perpendicular to the overchute inlet. This feature would be incorporated as a <br /> project design feature or a mitigation measure. If our recommended design feature is not <br /> incorporated into the final project design or included as a mitigation measure, DWR requests <br /> an analysis explaining why our recommendation for the retention basin discharges was <br /> rejected. <br /> XI. Land Use and Planning <br /> The IS/MND explains that any industrial development within the proposed project's parcels <br /> would require improvement of Hansen Road across the frontage of the project site to meet <br /> the San Joaquin County standards for a 60-foot-wide right-of-way for a local industrial road. <br /> The Department of Public Works reviewed the requirements and determined the owner of the <br /> property shall execute an irrevocable offer to dedicate a 25-foot-wide right-of-way from the <br /> centerline of Hansen Road to the property line across the parcel's frontage. <br /> The IS/MND needs to identify the owner responsible for the mitigation measure to provide the <br /> irrevocable offer to dedicate the right-of way along Hansen Road and analyze to what extent <br /> the proposed right-of-way dedication may impact DWR's property rights in the project area. <br /> XVII Transportation <br /> The proposed project would increase traffic on Hansen Road and Hansen bridge and would <br /> potentially significantly impact DWR's use and maintenance of the non-county portion of <br /> Hansen road and the DWR-owned Hansen bridge.
