As to the inspection of Defendant Southern Pacific's property by <br /> 3 Plaintiffs, the access agreement previously executed by Plaintiffs and Southern Pacific, a <br /> 4 <br /> copy of which is attached hereto, shall govern. As to other property, it is anticipated the <br /> a <br /> 6 parties will agree to a reciprocal right to inspect property on short notice, e.g., forty. <br /> 7 eight (48) hours. It is further anticipated that the parties will agree to provide notice to <br /> e each other of any inspection or testing, so that all parties will have the opportunity to be <br /> 8 present when such testing or inspection takes place. If any party determines that any <br /> 10 <br /> testing or inspection of any property should not be performed, e.g., for reasons of safety, <br /> 11 <br /> that party make seek relief from this Court on forty-eight (48) hours' notice to all other <br /> 12 <br /> 13 parties <br /> 14 5. Not later than fourteen (14) days after receipt by any party (or counsel for <br /> 15 that party) of a report from that party's expert or consultant, that party shall provide <br /> 18 each other party of record with a copy of that report; provided that no later than <br /> 17 September 8, 1992, all parties shall exchange experts' or consultants' reports they then <br /> 18 <br /> 18 possess. The expert or consultant reports shall identify, among other things, the specific <br /> 20 nature of the contamination on Plaintiffs' property, the specific location of this <br /> 21 contamination, the probable source of the contamination, the identity of probable <br /> 22 responsible parties, the locations of any pipelines presently or formerly in the immediate <br /> Z3 vicinity of the contamination, and a description of what those pipelines transport or <br /> 24 transported. All experts' or consultants' reports received by any party after September 8, <br /> 26 <br /> 1992 shall be provided to all other parties as soon as possible thereafter, but in no event <br /> 26 <br /> 27 later than fourteen (14) days after receipt. <br /> 28 6.
