(TTI) has completed soil and water testing <br /> of the North Parcel of the Dividend property in Tracy, California. <br /> The North Parcel is bounded by West Byron Road, Grant Line Road, <br /> and State Highway 205. Enclosed please find a copy of our report <br /> with addendum and a copy of our remediation workplan for approval. <br /> An isolated layer of residual diesel and crude oil has been <br /> identified at the West Byron Road property at MW-2, TPH <br /> concentration 4,200 ppm. No benzene was observed in the residual <br /> layer. The layer attenuates quickly with concentrations <br /> diminishing to 1,800 ppm at MW-3 and 220 ppm at MW-6. MW-3, MW-6, <br /> and MW-4 bracket MW-2 in a semi-circular pattern heading northward <br /> onto the Dividend property from the Southern Pacific pipeline <br /> easement parallelling West Byron Road. <br /> Negotiations with the Southern Pacific Pipeline Company (SPPC) to <br /> facilitate mitigation of the crude oil and diesel layer apparently <br /> discharged from the pipeline easement have been ongoing. The SPPC <br /> personnel, Mr. Tostengard and Mr. Ferrara, agree that crude oil and <br /> possibly other hydrocarbon product was, at times, pooled in the <br /> excavated easement in which the present pipeline was placed. The <br /> SPPC personnel contend that such pooled, free product was not <br /> considered hazardous when the SPPC pipeline was constructed and <br /> that presently, their pipeline shows no evidence of leakage. <br />
