Operations and Maintenance Plan <br /> Neighborhood C,Great Valley Parkway <br /> Mountain House,San Joaquin County,California <br /> Page 4-1 <br /> 4.0 DEED RESTRICTION REQUIREMENTS <br /> The Owner will be responsible for all Operations and Maintenance Activities. The following <br /> administrative rules shall apply: <br /> 1) The Owner shall give DTSC at least sixty (60) days of advance written notice prior to the <br /> intended date of any proposed modifications to the asphalt cap. General maintenance of <br /> slurry seal or crack filling does not constitute modifications. The written notice to DTSC <br /> shall include a detailed description of the work to be done or modifications to be made and a <br /> map showing the exact location of the proposed work and the reasons for modifications or <br /> disruption. No excavation work or soil disturbance activities shall occur directly in the <br /> Remediation System without prior approval by DTSC and the Owner. The work plan shall <br /> first be reviewed by a licensed Civil Engineer. <br /> 2) The asphalt cap shall be maintained in a manner to ensure that the public does not come into <br /> contact with the contaminated soil. Under no circumstances will the cap remain in disrepair <br /> for a period longer than ninety (90) days following discovery of damage. Further, the <br /> condition of the cap and any required maintenance shall be evaluated as part of the annual <br /> inspection. <br />
