Failed to conduct annual hazardous waste training. Last training conducted for "CA Hazardous Waste" training was on 01/07/2011 by KPA representative Sharon. Training must include hazardous waste emergency response and handling. Records must include employee job title/ responsibilities. Facility personnel shall complete an annual refresher that is designated at a minimum to ensure personnel are familiar with storage, handling, disposal of waste, emergency procedures, equipment & systems, in accordance with CCR 22, Section 66265.16. Correct by providing copy of training program and its records to SJC EHD. 122, 123, & 124. Manifest numbers Jk shipped on 02/23/2012 and 009840266JJJ shipped on 06/14/12 for were not found with a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository, Generator Information Services Section P.O. Box 806, Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifest or a copy of the exception report submitted to DTSC. Submit to SJC EHD within 30 days (08/20/12): 1. one copy of the completed "Return to Compliance Certification" form 2. a written corrective action statement 3. requested /supporting documentation ie. disposal receipts, training program & record Notes: -In 2011 year, facility generated approximately 7150 gallon used oil (28.6 tons), and 850 gallon of used antifreeze (3.4 tons), and 4.21 tons of manifested waste = 36.21 tons of hazardous waste. - Provided: Free hazardous waste training schedule, hazardous waste labeling instruction ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
