Failed to conduct annual hazardous waste training. Last training conducted for "CA Hazardous <br /> Waste" training was on 01/07/2011 by KPA representative Sharon. Training must include hazardous <br /> waste emergency response and handling. Records must include employee job title/ responsibilities. <br /> Facility personnel shall complete an annual refresher that is designated at a minimum to ensure <br /> personnel are familiar with storage, handling, disposal of waste, emergency procedures, equipment & <br /> systems, in accordance with CCR 22, Section 66265.16. Correct by providing copy of training program <br /> and its records to SJC EHD. <br /> 122, 123, & 124. Manifest numbers Jk shipped on 02/23/2012 and 009840266JJJ shipped <br /> on 06/14/12 for were not found with a signed off copy from the destination facility. Hazardous waste <br /> generators shall retain copies of all manifests signed off by the destination facility on site for three years <br /> and have them readily available for review. If the generator did not receive a copy of the manifest with <br /> the handwritten signature of the owner or operator of the facility to which the generator's waste was <br /> submitted within 35 days of the date the waste was accepted by the initial transporter, the generator <br /> shall contact the transporter and/or the owner or operator of the designated facility to determine the <br /> status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within <br /> 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an <br /> Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the <br /> generator explaining the efforts to locate the hazardous waste and the results of those efforts. <br /> Exception reports shall be submitted to: <br /> DTSC Report Repository, Generator Information Services Section <br /> P.O. Box 806, Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. <br /> Submit to the EHD a copy of the signed off copy of the manifest or a copy of the exception report <br /> submitted to DTSC. <br /> Submit to SJC EHD within 30 days (08/20/12): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement <br /> 3. requested /supporting documentation ie. disposal receipts, training program & record <br /> Notes: <br /> -In 2011 year, facility generated approximately 7150 gallon used oil (28.6 tons), and 850 gallon of used <br /> antifreeze (3.4 tons), and 4.21 tons of manifested waste = 36.21 tons of hazardous waste. <br /> - Provided: Free hazardous waste training schedule, hazardous waste labeling instruction <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME A HD'S CURRENT HOURLY RATE. <br /> EHD Inspector: qecevedy: Title- <br /> Thuy Tran (209) 468-8257r <br /> EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
