DEC. 12 1997 12 : 22FM PACIFIC OVERSIGHT MO, 5350 P. 6 <br /> Sacramento CA 95834-1943 ("EMCON") as Grantee's primary agent and contractor to <br /> perform and manage the Permitted Activities contemplated in this Access Agreement. <br /> Grantee retains the right to designate other agents or contractors to perform the <br /> Permitted Activities in this Access Agreement, after notice to Grantor and Grantor <br /> grants approval, which approval is not to be unreasonably withheld . <br /> F, Grant of Access <br /> Under this Access Agreement, Grantor, as the owner of the Property, <br /> hereby grants its permission to Grantee and Grantees' Agents to have access to the <br /> property in order to perform the Permitted Activities subject to the terms and conditions <br /> set forth herein . <br /> 3 . ReAuest for Aeeess <br /> Prior to the, performance of any Permitted Activities on the property, <br /> Grantee or Grantee's Agents shall provide Grantor or Grantor's designated <br /> representative with a written notice describing the Permitted Activities to be performed , <br /> the anticipated dates and times when and specific locations where such Permitted <br /> Activities will be performed , the equipment that will be used to perform such Permitted <br /> Activities, and the names of the persons who will be supervising the work contact <br /> telephone numbers for such persons and the entities conducting the work. Each written <br /> notice for access shall be provided at least fourteen (14) days prior to the anticipated <br /> date of commencement of entry onto the Property to perform the requested Permitted <br /> Activities on the Property, except in the case of an emergency , in which case Grantees <br /> must make reasonable efforts to contact Grantor prior to performing activities , and <br /> shall, in any event, contact Grantor as soon as practicable Grantor shall respond , in <br /> writing , with in the fourteen ( 14) day period with any specific conditions for the <br /> Permitted Activity which are consistent with this Agreement. <br /> 4, Governmental Authorization for Permitted Activities <br /> Grantee and Grantee's Agents shall obtain and maintain all necessary <br /> permits and authority from San Joaquin County Public Health Service Environmental <br /> Health Department (SJC PHS-EHD') and other governmental entities and agencies and <br /> comply with all current and future laws, ordinances, rules, regulations and permits with <br /> respect to their performance of the Permitted Activities, <br /> 5, Waste Generation and Management <br /> Grantee shall be the designated generator of any waste produced in <br /> performing the Permitted Activities , and shall be fully responsible for the preparation <br /> and execution of any manifests required for the management of such waste, in <br /> accordance with all applicable federal, state and local laws regulations and <br /> requirements . <br /> Page 2 of 7 <br />
