Representing Color <br /> Spot were Debra Summers and Vivian Clausing of the law firm <br /> Wilson, Sonsini, Goodrich and Rosati and Jerome Summerlin of the <br /> environmental firm of Staal, Gardner and Dunne. Representing <br /> PHS/EHD was Linda Turkatte. <br /> The directive from PHS/EHD to Color Spot to conduct a groundwater <br /> investigation at this site was the issue of discussion at the <br /> meeting. <br /> The predominantly sandy soils at the site, the low levels of <br /> contamination found in the soil samples collected from the <br /> finished excavation (1/90) and the soil borings (10/90) , the <br /> toluene detected in monitoring well MW#1 (5/91) , and the benzene <br /> and toluene detected in domestic wells located to the north- <br /> northwest of the former tank pit area (1/90) are the basis for <br /> the directive from PHS/EHD to Color Spot to conduct a groundwater <br /> investigation at this site. <br /> PHS/EHD maintains that, a groundwater investigation is warranted <br /> and that, closure of this site will not be considered until the <br /> groundwater quality beneath the former tank pit is investigated. <br /> Representatives of Color Spot may continue to disagree with this <br /> directive and may elect to appeal to the State Water Resources <br /> Control Board (SWRCB) for a decision. Therefore, the deadline in <br /> the letter from PHS/EHD to color spot, dated June 29, 1993 ,. for a <br /> workplan submittal is extended for sixty days to accommodate an <br /> appeal to the SWRCB.
