PUBrIC HEALTH SEIVICES
SAN JOAQUIN COI;NTY
JOGI KHr NNAS.D..INI.P.H.
-- Health Officer
P.O. Box 2009 + (1601 East Hazelton Avenue) •Stockton. California 95201
(209)46&3400
AUC 2 1
KEVIN ALLEN
COLOR SPOT INC
P 0 BOX 5011 AUG 10 1993
RICHMOND CA 94805
RE:; 5400 EAST HHARNEY LANE SITE CODE.* 2343
LODI CA
A meeting was held on August 2, 2993 at the office of San Joaquin
County Public Health Services, Environmental Health Division
(FHS/EHD) to discuss the above noted site. Representing Color
Spot were Debra Summers and Vivian Clausing of the law firm
Wilson, Sonsini, Goodrich and Rosati and Jerome Summerlin of the
environmental firm of Staal, Gardner and Dunne. Representing
PHS/EHD was Linda Turkatte.
The directive from PHS/EHD to Color Spot to conduct a groundwater
investigation at this site was the issue of discussion at the
meeting.
The predominantly sandy soils at the site, the low levels of
contamination found in the soil samples collected from the
finished excavation (1/90) and the soil borings (10/90) , the
toluene detected in monitoring well MW#1 (5/91) , and the benzene
and toluene detected in domestic wells located to the north-
northwest of the former tank pit area (1/90) are the basis for
the directive from PHS/EHD to Color Spot to conduct a groundwater
investigation at this site.
PHS/EHD maintains that, a groundwater investigation is warranted
and that, closure of this site will not be considered until the
groundwater quality beneath the former tank pit is investigated.
Representatives of Color Spot may continue to disagree with this
directive and may elect to appeal to the State Water Resources
Control Board (SWRCB) for a decision. Therefore, the deadline in
the letter from PHS/EHD to color spot, dated June 29, 1993 ,. for a
workplan submittal is extended for sixty days to accommodate an
appeal to the SWRCB. The new deadline for the submittal of a
workplan is October 25, 1993.
EXHIBIT A-2
A oMmon of San Joaquin County Health t:arc*mces \.
