11 only constituents not associated with the UST or at naturally-
2 occurring background concentrations, which do not warrant clean
3 up under established State guidelines.
4 8. Based on the foregoing, it is our opinion that this
5 UST case does not warrant further soil or groundwater evaluation
6 at the Site, particularly given the costly work requested by the
7 Health Department. Further, it is our experience that owners and
8 operators are not typically required by regulatory authorities to
9 conduct additional investigation under these circumstances.
10 9. In this regard, it is our understanding that the
11 Health Department has based its demand on further work on the
12 presence, at low levels, of benzene in the agricultural supply
13 wells. However, this detection did not result from the UST.
14 None of the soil samples collected during the excavation of soil
15 in the vicinity of the tank nor in any of the other soil samples
16 at the site contain benzene. Moreover, the level of benzene that
17 was detected (ten times lower than the action level) does not
18 warrant further investigation.
19
20 Executed this IS'OON— _ day of 1993 in
21 Emeryville, California.
22
23
Thomasohnson
24
25
26
2711
28
-6- VMaCOLORSPIVOHNSONMEC
