j <br /> F RIGHT OF ENTRY AGREEMENT. <br /> This Right of Entry Agreement (the °'Agreement") is entered into as of AugusQL,2000 by and <br /> between STORAGE PRO (the "Owner"), and DHOOT BROS. PARTNERSHIP, INC.j{ A <br /> California corporation ("DHOOT"). <br /> Recitals <br /> f <br /> p � <br /> A. Owner is the owner of that certain real Property located at 15550 S. Harlan Road, <br /> Lathrop, California (the "Property"). <br /> I <br /> 1 <br /> j <br /> B. DHOOT is the operator of a Joe's Truck Plaza and Mini Mart located adjacent and south <br /> of the Property, with a street address of 15600 S. Harlan Road, Lathrop, California (the "Gas <br /> Station"). <br /> , i <br /> I <br /> C. The County of San Joaquin Department of Public Health Services, Environmental Health <br /> Division (the "County'',) is overseeing the investigation of petroleum hydrocarbon contamination <br /> found at the Gas Station and has required DHOOT to undertake certain additional <br /> environmental assessment activities associated therewith. { <br /> 1 <br /> D. The petroleum'hydrocarbons may have contaminated the soil and groundwater and may <br /> have migrated from the Gas Station in such a manner that the plume may be underneath tI he <br /> Property. <br /> t <br /> E_ DHOOT has retained Avalon Environmental Consultants who possess the necessary <br /> professional engineering, geological, hydrogeological and technical expertise to investigate and <br /> j <br /> remediate environmental contamination of the type that could be emanating from the Gas <br /> Station. <br /> F. DHOOT has requested permission from Owner to drill four (6 borings on the Property';to <br /> a depth of approximately twenty (20) feet each in the approximate areas shown on Exhibit "A" I <br /> attached hereto (the "Borings") in accordance with the Work Plan and San Joaquin County letter <br /> dated April 3, 2000 and San Joaquin County Approval dated May 18, 2000 attached hereto 'as p <br /> Exhibit "B" (collectively, the "Work Plan") and to collect soil samples and grab groundwater 1 <br /> samples therefrom.
