1J l V I DHOOT and its agents, contractors; consultants, subcontractors or other representatives (herein the "Representatives") may enter upon the Property for the purpose of drilling and sampling the borings for hydrocarbon contamination (collectively, the "Investigation Activities").,'i G. In granting this license to enter the property, Owner does not waive any of Owner's legal rights. I H. The performance of the Investigation Activities will be at no cost or expense to Owner and the parties recognize that all workwill be performed by DHOOT or its representatives. - I I. After DHOOT conducts its Investigation Activities of the property, it shall bear the responsibility to abandon and/or destroy any borings so as to not disrupt future development activities on the property and in full compliance with the law. J. It is the desire and intention of DHOOT and Owner to snake this mutual agreement with respect to the proposed Investigation Activities. K. The parties hereto agree and acknowledge that in signing this agreement that they are not admitting any fact that their prior conduct or the prior conduct of their predecessors in interest in any manner formed or forms the basis of any liability as between the parties or as i between any party and any third party` Now, therefore, in consideration of the above recitals and DHOOT's covenants and agreements contained herein, Owner agrees to and hereby grants a right of temporary entry onto the Property to DHOOT and its representatives for the aforementioned purposes, subject to the following terms and conditions: Agreement 1. Right of Temporary Entry. Owner hereby grants to DHOOT and its representatives temporary and revocable permission to enter upon the Property solely for the following exclusive purposes: (a) Drilling and sampling the borings for hydrocarbon contamination in accordance with the Work Plan and to the satisfaction of the County and the Owner, RIGHT OF ENTRY AGREEMENT P. 2 OF 9 L
