Tracy facility is regulated by the Central Valley Water Board under Waste Discharge <br /> Requirements (WDRs) Order R5-2003-0050. On 15 June 2012, Spreckels informed Board staff that <br /> facility had been sold to Holly Commerce Center, LLC. <br /> The WDRs regulate a discharge of industrial wastewater from a sugar beet processing facility at <br /> 20500 Holly Street in Tracy. Spreckels has not operated the sugar processing plant for several years <br /> and has cooperated with Board staff in closing the former precipitated calcium carbonate ponds. We <br /> understand that there is currently no discharge to the industrial wastewater system, with the exception <br /> of storm water runoff from portions of the site. <br /> Planned Rescission of WDRs <br /> The WDRs were developed to regulate the specific waste character, discharge locations and <br /> discharge methods associated with the sugar beet processing plant. Although the WDRs are <br /> transferrable to a new facility owner, the new owner can only discharge waste that is essentially <br /> identical in character and must use the same treatment and disposal systems as the original <br /> permittee. It is our understating that future development of a sugar beet processing facility at the site <br /> is unlikely, so the current WDRs are no longer appropriate or necessary. Therefore, we plan to <br /> recommend that the Central Valley Water Board rescind WDRs Order R5-2003-0050 at its <br /> 3/4/5 October 2012 meeting. <br /> Application for New WDRs <br /> For future development at the site, industrial wastewater discharges will be subject to regulation by <br /> the Central Valley Water Board unless the facilities will be connected to a public sewer system. <br /> Therefore, if there will be no sewer connection, new WDRs must be adopted by the Central Valley <br /> Water Board before industrial operations commence. <br /> The WDRs permit process begins with submittal of a Report of Waste Discharge (RWD) with the <br /> applicable filing fee and the required technical information. Once the RWD is determined to be <br /> complete, we will schedule permit development. The permitting process includes a 30-day public <br /> review of draft (tentative) WDRs and a public hearing by the Central Valley Water Board. Due to our <br /> (CARL E.
