Box 2098 <br /> Stockton, California 95201 <br /> CONSENT AGREEMENT COMPLIANCE DEFICIENCIES, ROUGH AND READY ISLAND, <br /> STOCKTON, SAN JOAQUIN COUNTY <br /> California Regional Water Quality Control Board, Central Valley Region (Regional Water <br /> Board) staff believes that the Port of Stockton (Port) is not in compliance with the Consent <br /> Agreement (CA) the Port signed with the Department of Toxic Substances Control (DTSC) and <br /> the Regional Water Board in July 2003. We are writing to remind the Port of its obligations <br /> under the CA. We hope that these issues can be resolved at the informal level without having <br /> to resort to formal action. As such, we are requesting to meet with a representative of the Port <br /> to discuss and, we hope, resolve these issues as soon as possible. Based on our past <br /> discussions with the Port, we have assumed that you are the appropriate person to attend <br /> such a meeting. Regional Water Board staff has identified the compliance issues listed below. <br /> 1. Annual remediation schedule revisions required by the CA have not been submitted <br /> by the Port (Section IV of the CA). The last remediation schedule was submitted to <br /> the Regional Water Board in 2004. Please submit the 2006 schedule revision by 31 <br /> August 2006. The accompanying narrative with the schedule needs to include <br /> activities that have been completed on the previous remediation schedule, an <br /> explanation for activities that have been delayed, and revised completion dates for <br /> delayed activities. As a reminder, this schedule is to be submitted for Regional <br /> Water Board and DTSC approval. Once approved and final, the schedule becomes <br /> the enforceable schedule by the State for the cleanup under the provisions of the <br /> CA. <br /> 2. The Port should not deviate from the schedule without approval from the Regional <br /> Water Board and DTSC. Due dates for activities listed in the 2004 schedule have <br /> not been met by the Port, and the Port has not followed the agreed upon procedure <br /> for requesting time extensions (Sections 5.14 and 5.15 of the CA). <br /> California Environmental Protection Agency <br /> p�aRecycled Paper <br />
