CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> RESOLUTION NO. R5-2005-0151 <br /> AMENDING WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2003-0065 <br /> NPDES NO. CA0078093 <br /> FOR <br /> DEPARTMENT OF CORRECTIONS <br /> DEUEL VOCATIONAL INSTITUTION <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region(hereafter Regional <br /> Board), finds: <br /> 1. On 25 April 2003, the Regional Board adopted Waste Discharge Requirements(WDRs) Order No. <br /> R5-2003-0065,NPDES No. CA0078093, prescribing waste discharge requirements and <br /> monitoring and reporting program for the Department of Corrections, Deuel Vocational Institution <br /> (hereafter Discharger), San Joaquin County. <br /> 2. The Discharger owns and operates a wastewater collection,treatment, and disposal system, and <br /> provides sewerage service to Deuel Vocational Institution. The treatment plant is in Section 20, <br /> T2S, R6E, MDB&M, on property owned by the State of California's Department of Corrections as <br /> shown in Attachment A of the Order. Treated municipal wastewater is discharged into Deuel <br /> Drain, a water of the United States, approximately 4 miles east of Tracy, at the point, latitude <br /> 370 45' 02" and longitude 121° 19' 35". Deuel Drain is part of the Sacramento-San Joaquin Delta, <br /> and is tributary to Paradise Cut and Old River. <br /> 3. In addition to the domestic wastewater discharge, the Discharger also discharges commingled <br /> industrial wastes, storm water and contaminated groundwater into Deuel Drain from Outfall 003 <br /> and Outfall 004 shown on Attachment A of the Order. <br /> 4. The monitoring and reporting program of Waste Discharge Requirements Order No. <br /> R5-2003-0065 requires, in part,the Discharger to monitor wastewater treatment plant influent, <br /> wastewater treatment plant effluent, industrial Outfall 003 and 004 discharges, and receiving <br /> water. <br /> 5. On 1 June 2005, the Discharger submitted a request to reduce the monitoring frequency for <br /> wastewater treatment plant influent, wastewater treatment effluent, industrial Outfalls 003 and 004, <br /> and receiving water stations R-lA and R-1B, consistent with other dischargers in the region. <br /> 6. The Discharger's request for a reduction in monitoring frequency, does not relax effluent discharge <br /> limitations and thereby complies with sections 402(0)(2) (33 U.S.C. section 1342(0)(2)) and <br /> 303(d)(4) (33 U.S.C. section 1313(d)(4)) of the Clean Water Act(CWA) and federal regulations at <br /> 40 CFR section 122.44(1)that prohibit backsliding in NPDES permits. <br /> 7. In addition, Finding 39 of WDRs Order No. R5-2003-0065 states in part the WDRs "...shall take <br /> effect 50 days following permit adoption (effective 25 April 2003)..." Finding 39 contains a <br />
